First MH now CAPQUEST!!!

After receiving letters from MH re an outstanding debt they claimed they had bought from the original creditor , I sent a CCA request with no response then they tried the same with another of their companies I sent a letter stating as the debt was in dispute they could not use any of their companies.
Now I have received two letters from CAPQUEST for the same debt which they claim to have bought of the creditor, the first was a once in a life time offer which I ignored, the second is from their litigation dept giving me till the 6th of Dec to call them to make arrangements to pay or they will pass the case on to their solicitors.
A couple of questions.
Firstly how can MH and Capquest both own the debt? do i send another CCA request?
Secondly, I am now in a position to pay the original creditor(CCA obtained from them) are there any useful letters i can send to arrange this or should I phone them?

    if the original creditor has supplied you with the original CCA, there is a good chance that they will supply it to crapquest or some such. I am surprised they did not supply it to MH.

    When does this debt relate to? How ling sicne you last paid?

    Both these DCAs have a habit of claiming on debts that are or shortly will be statute barred.

    If there had been an interval of 6 years between payments, the debt would have bene unenforceable.

    I think what you will find is that MH sent the debt back to the original crditor and they have sold it on to capquest. Try the CCA with capquest. if they do not come back with the CCA, get to the creditor really quickly if you want to pay this off.

  • Did you obtain the CCA separately from the letter you sent MH? If so then MH cannot pursue you any further. You could do the same with Capquest and send them the £1 though you should be prepared for them to produce the documents. Just thinking aloud here

    This is a money saving site - not a debt avoidance one; there are at least two others who specialise in that sort of advice.

    Do you know what this debt relates to ? If not then by all means query it with the dca. If you do know what it was for why don't you contact Capquest (in writing if you prefer) and make an arrangement to pay based upon your ability. If you need help arriving at a realistic payment amount then post your income and outgoings on here and many people will help you.

    Thank you - didn't spot that. If that's the case it makes absolutely no difference whether they pay the dca or the lender directly - either way the dca will get the commission from the payment. In fact if you pay the lender directly it actually saves the dca money by not having to process the payment.

    It is possible, even probable, that niether MH or CRAPQUEST actually own the debt - rather that they are both 'Bounty Hunting' on this 'alleged debt' in the hope of earning a fast buck.
    I suggest that you do, indeed, keep all correspondence, regarding this matter, and, certainly any intended payment, between yourself and the original creditor.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.
