Tupe transfer rights

hi all. We are currently going through a type transfer which is supposed to be completed in a few weeks. In the letter from HR there is this piece of writing .

They are giving us more holidays and full sick pay which we currently do not get which is great. However in the photo above the way I understand it is if we accept the terms we r revoking all our tupe rights which means they could then do what they want with us,? For instance dangle a carrot then withdraw after we give up out rights . Have I read this right not sure.

    You are not giving up any rights. You either accept the improved terms or default to your existing contractual terms. Under TUPE you cannot be put in a worse position.

    I've been in this position before - basically it can be an administrative pain in the wotsits for a company who takes on  people from a lot of different complanies under TUPE to keep track of all the individual terms and conditions of the previous companies, as the TUPE regulations require. So they'll offer the incoming people being TUPEd an opportunity to switch to the T&Cs of the new company (which could be better, worse or most commonly simply different to that of the old company). But it should be up to the individual to decide if they wish to accept the new T&Cs or stick to their exisitng ones.

    Just needed that clarifying we r getting 35 days holiday from 20 and no sick pay to full for 6 months per year so it's all good
