renewing contract for new car and licence not provisional

Hi guys, My cousin has got a car on PCP leasing and wants to trade up to a new car. She went to her dealer and started to go through the process, picked a car and the salesperson contacted Black Horse and they were happy with the trade up and started the paperwork for it. Now she had a phone call today from Vospers has now said Black Horse finance has refused the application on the grounds that she only holds a provisional licence. This was already known by Black Horse finance 3 years ago when the original PCP leasing contract was taken, They told us the rules changed last year and they were not able to accept the provisional licence.

    If she has been driving for three years, why does she still have a provisional licence?
    If she is still a learner, how can she have covered enough miles to warrant changing to a new car already?

    Over a period of 3 years terms business terms can change. Those for mortgage can be overnight.

    I don't see a clear question from your post but many questions about the contents of the post to try to understand and maybe offer support.

    There's nothing she can do if they're not willing to proceed.

    In any case, she's better off keeping her current car, especially if she doesn't yet gave a full license.

    They've done her a favour.

    The title of your post is a bit misleading, where you say 'licence not provisional'. But what can be done in regards to the licence issue is that she can actually take a driving test. It's difficult to believe that she's already been driving for three years on just a provisional licence. That means she should have been out driving with someone else who has a full licence, what a performance!

    As someone who does have a full UK driving licence I have to say that I'm glad her application has been denied. I know people are allowed to buy cars with only a provisional licence but it's unlikely she's going to get a car on lease any more. Thank goodness.

    Nothing other than take a driving test. Black Horse have a list of requirements, she's not meeting them. There is nothing in law forcing a lender to lend to someone, there's nothing in law to prevent them deciding who to lend to as long as that criteria isn't an "ism" discrimination on the list of protected criteria and I doubt being a provisional licence holder is on that list.
