Estate Rental Charge

Really need advice please stressed out a out this.
Morgage offer came through eventually with barclays.
We were supposed to exchange complete two weeks ago didnt happen due to enquiries not answered. They got completed.
Then were supposed to exchange last Friday another bombshell from my solicitor after repeated phone calls to try get hold of him. Barclsys wont lend with the Estate rental charge worded as it is on the transfer deed they are asking for a variation. Something to do with if I got into arrears then there would be some kind of lease.something on the line that prohibits them from being able to create a lease. Its confusing but I'm not sure what to do is anyone at fault for not picking this up sooner? and or is it something that can be sorted. Any help much appreciated its took me 5 months to get this far I'm so stressed to get this far and now this has happened. I've asked other people on the new build sites where it is and no one seems to have had any issues.
Any advice would really help right now. My solicitor is not helping and I only have 3 weeks left in my current property.

If it is just Barclays being picky, maybe choose another lender. Would have to go through the whole application / valuation process again, but if it gets you the house....0

It means I would have to find somewhere else to live plus alot of lenders dont take overtime into consideration.moneysavinghero said:If it is just Barclays being picky, maybe choose another lender. So I'm stumped...think it's just Barclays being picky..so whatever way I think I just have to accept I've lost the house.
Thank you anyway. I will be suing barclays for all their blunders on my application from the start and for them to have done this now after the mistakes they made is just not on.
Thank you.0 -
This isn’t necessarily Barclays fault, they have criteria and it’s the Solicitors job to make sure that you and the property you are buying adhere to that criteria. It sounds like your solicitor really needs a kick to get things moved along and sorted...I am a Mortgage AdviserYou should note that this site doesn't check my status as a mortgage adviser, so you need to take my word for it. Is it that you would be in an assured short hold tenancy because the amount is higher than £250 a month and if you miss a payment they can claim the property within 8 weeks and not tell your lender? An indemnity policy might sort it out - worth trying1

It's to do with an £207 pounds yearly service estate maintenance charge..about 17 pounds a month something on the lines the way its worded.. it's all confusing.28tsw said:Is it that you would be in an assured short hold tenancy because the amount is higher than £250 a month and if you miss a payment they can claim the property within 8 weeks and not tell your lender? But thank you so much I'll keep plodding on and see what happens. Surely other lenders must have picked this up.0 -
Thank you I understand that it's just Barclays have made alot of blunders on my case. I was offered the morgage back on march my case number my name not my house though. Then they lost my application. Anyway I respect what you have said I'll keep plodding on see if the solicitor can sortLRmortgage said:This isn’t necessarily Barclays fault, they have criteria and it’s the Solicitors job to make sure that you and the property you are buying adhere to that criteria. It sounds like your solicitor really needs a kick to get things moved along and sorted...

This is the what that are saying we notice the estate is subject to an estate rent charge yearly for services under the transfer date march 18.please ask for the rent charge owner for a variation which either probitits them from being able to create a lease or provides immediate surrender on any lease of payment of arrears and costs but withoit premium and which requires them to notify the lender of any other legal action. This is a requirement of some morgage lenders and without it the property maybe come unmorgagableLRmortgage said:This isn’t necessarily Barclays fault, they have criteria and it’s the Solicitors job to make sure that you and the property you are buying adhere to that criteria. It sounds like your solicitor really needs a kick to get things moved along and sorted...
14 of the plots all gone through no problems but most with Halifax and nationwide. Mine is on hold
Plot 21 the same sold 8 weeks ago completing Wednesday I'm still on month 5.
Total bad luck for me
Is there anything else I can do to get this far have morgage offer signed deeds contract etc. Should this have been sorted sooner either solicitor..

Just wondering if you had an outcome, we are in the same position, our seller will not amend the transfer document.
Seem to just be going round in circles now.
Did you manage to sort this?
Thanks 🙏
