Unenforceable debt due to lack of CCA

Hi All,
I have just received a letter from Cabot saying that as they cannot provide the CCA from a credit card debt, the debt is currently unenforceable.

The account was opened in 1997 and defaulted in Nov 2014 - so, in theory, will drop off my file in 4 months time. I really want to get in a better position financially though and would rather get rid totally without running the risk of it rearing its head again.
At what point should i offer a low F&F to Cabot to get rid of totally?

    Cabot have a habit of sticking to their guns unfortunatly.
    If the account was opened in 1997, no way will this ever rear its head again, paperwork is only kept a maximum of 7/8 years, dependant on lender, i think you can safely say goodbye to this one.
    Once its dropped off your file, if things stay the same, it can`t come back, under any circumstances.

  • I recently offered Cabot a F&F as I was in the same position. They refused but still bombard me with requests to pay. I ignore them.

    Do you mind me asking?...what % did you offer? Did they counter offer?

    I've not got any UE's with Cabot, but do with another DCA and whilst it was reported as UE around 3/4 years ago - they are offering low discounts on only 2 out of the 3.  The 3rd (the highest amount) they are sticking to their guns and only offering 10%.  The reason I'm posting is simply to echo what's been said already - there's no guarantee on F&Fs, nor is there any magic number (as far as discounts go).  If you want to try your arm, decide on a figure that you are happy with and make the offer.  But by the sounds of it Cabot will hold out regardless of the account's recovery status.  So if they reject, then simply file the paperwork away and ignore them.

    Thank you! Yes i will just ignore them and focus on my other outgoings. 
  • Hi, just an update. Once Cabot sent the letter stating they couldn’t provide the CCA, i just filed it away and did nothing. I have received another letter today offering a 75% discount and my account will be closed. I can afford to pay this reduced amount and i am tempted to do so even though the default drops off in 3 months anyway. I really want to apply for a mortgage in the near future and wouldn’t it look better to have this satisfied?

    In 3 months no one will know or care, i`d save your money, Cabot make enough off other poor souls not as fortunate as you are, but its your choice.
