on IPA and partner started gambling

to make long story short, I’m on IPA until this year December . Moved in with partner last year October , therefore IPA has been reviewed .This year due covid partner had no work so I paid full rent rather than my part only , it has been agreed with OR so I had 3 months payments wrote off. Partner came back to work and my income payments have to be restarted, all good, and just find out he has problem with gambling and no money ! Despite I’m shocked and just felt so down with everything, I need to understand what to do . Rent contract is on both names , if I will pay my part only , landlord has full right to ask me pay in full if partner won’t pay. So how I can maintain my IPA payments in that case? jesus, when I thought this all hell goes to the end , and I’m close to the really fresh start, this has happened. It will be clear if I’m making decision to split with him, and ask him to leave, but at the minute everything just the hell. any advise please?

  • I'm sorry you're having to go through this just when you could see the end.
    With the rent as you are joint tenants you are both liable for the full rent if the other joint tenant doesn't pay. As this is the roof over your head the trustee may allow you to pay the full rent to ensure you have somewhere to live and change your IPA to reflect this. However they could fall back on the fact that your partner not paying the rent has nothing to do with your bankruptcy and they could only allow you to pay half.
    Is your partner paying the other bills such as council tax, utilities, TV licence etc? You can get support from Gamcare to help you address this with your partner.
    All you can do is explain the situation to the trustee managing your IPA and see how they respond. I hope they are symapthetic for you and help with what is a very difficult situation for you.

    As above, explain the situation to the OR, they are not here to punish you.
    An IPA is not set in stone, its an amount you pay toward your debt, according to your income, if things change, then your IPA changes with it, speak to the OR as soon as possible.
    You will not be the only one in this situation during these turbulant times.

    Thank you very much. I had contacted with gamcare yesterday to see how they can help him and myself also. I have asked my partner to contact them as well , atm I’m not sure how it will affect our relationship as I gone trough my personal hell in the past and those “news “about his gambling are defo not what I wanted. If he doesn’t lie, at least he didn’t take any payday loans or so. his financial situation is all arranged overdraft has been used which is £2900. he just literally has no money . but good thing is he has job.
    this month bills such a water, CT have been paid by DD from his overdraft . 
    electricity/gas just topped up by me. rent paid in full by me.
    Hes next pay in few weeks time, trying to see options how dont let him to spend those money again , head just spinning

     the thing is my OR was very helpful and when partner didn’t have job due covid, he allowed me to pay whole rent and 3 IPA payments have been written off. My next payment has to be early August, I’m so worrying how to explain him this all. How to prove all I’m saying ?

  • Your bank statement showing the payments to your landlord however it's up to the OR what they want. They might not even want anything.
    I'm sorry I can't give you more advice as its up to the OR and its always individual.

    I will send an email today to see what he thinks.
    The problem is rent and bills not in arrears yet, so looks like all good but I need to plan in advance , I can’t just pay my share and expect him to pay his part when he hasn’t got money.
    To find out in some point  from landlord he didn’t pay  won’t be great

    just little update:
    OR feel sorry about my situation but because partner earning money, or can’t be involved in our affairs. that’s right, of course, but I have said if he won’t pay rent /bills , I won’t have choice just cover whole amount , I just will keep him update 😶
    fingers crossed situation will improve
