Employment Tribunals - Acas Certificate

Hi just wondered if anyone has had any experience of submitting the ET1 form ? I’m feeling sick as I think I might have submitted it too late ! The Acas certificate ended 24.7.20 but due to the crap internet I have by the time I submitted the ET1 the date was the 25.7.20 !! Do you think the Tribunal
will accept it as it’s only a few hours late and it was a Friday so it won’t get looked at until the Monday ? Im
so mad with myself for leaving it until the last minute! Any help or advice would be greatly appreciated.  Thank you

They're usually pretty strict. What was the claim?

  • The claim is hopefully sex discrimination I have a male comparator! Im thinking of ringing them on Monday morning to see if I can plead with them !
Im So mad 😠 with myself and trying not to beat myself up about it as I’m so upset !

  • To make things more complex I was issued with 2 certificates ! One doesn’t run out until the 29.7.20 so I’ve logged an ET1 for that as well ! Im Just confused about it all but just hoping they will allow my claim ! Has anyone else been just over the deadline ?

Did you begin the pre-claim conciliation process with more than 1 month left on the 3-month overall time limit? If so, you have the remainder of the original time-period to submit the claim.

Any idea why you were issued with 2 certificates?
  • Basically I was dismissed (unfairly but have less than 2 years service so claiming sec discrimination and have a male comparator) on 18.3.20 so the original claim date was 17.6.20.  Acas conciliation started 29.5.20 and the certificate was issued on the 24.6.20 as employer didn’t want to conciliate ! I think I got it in my head that the new deadline was 29.7.20 which potentially is if I can use the other certificate which was issued on the 29.6.20 ? I’ve just got myself all worked up about it and feel really sick now as worried that the Tribunal might not accept it ? The other later certificate was initially a further back up as they hadn’t paid me my mileage claim for March but they’ve paid it now do not sure if I could use that later certificate ? I’ve been up all night researching trying to find a loop hole round it as I know it’s complicated ! Anyone got any ideas please thank you 🙏

  • I’ve read that potentially you can add extra days on ?? Not sure if I’ve worked mine out right ? If the conciliation period started on 29.5.20 and ended on 24.6.20 that is 26 days so can this 26 days be added on further to the date the 1st certificate was issued on 24.6.20 ? Or was the deadline just a further month when the clock  stopped on the 24.6.20 which would make the date the 24.7.20 ? Im so confused and stressed out over it all - are there any employment lawyers on here who could help please ? Thank you
