BW Legal & Perfect Home

Hello everyone,

I currently have BW Legal sniffing round me again. Apparently I owe in excess of £2000 pounds to Perfect Home.
My circumstances is that I left my ex relationship that had this account. The Account was in my name but I left the items in the home (wrong I know) but I didn't want to leave my children with nothing to sit on etc.

Anyway, I'd like to pay my debts but this is a lot of money and has only come about as my ex stopped paying for the items but never told me.

I have however asked for SAR and received this today. It only has a few letters that were sent to my new address from BW Legal and a list of the items. There is no signed perfect home contract from BW Legal or the previous debt collector. I am just wondering if this would actually stand in court.

BW Legal sound like awful people and I'd rather not pay them.

Thanks for you help!

Ask then specifically for a copy of the agreement.

It's not a question of whether they're awful or not, but if it's a valid debt.

Thanks zx81, when i called them last month I asked them for a signed copy of the original agreement and it would appear that they do not have this.

They don't need to produce the original signed copy, just a representative copy or the loan you agreed to.

Don't think you are going to avoid paying this debt. Don't think it will end well for you if you let this go to court.

Fair enough. I got another email from them with the account statement. That’s all the information they have. It’s not that I want to get out of paying it, I’m just annoyed that I have only been sent letters this year when they have my new address and the payments stopped in May 2017. I never received any letters informing me of the default.

You must make the request in writing enclosing the statutory £1 payment for it to be legally valid -
No agreement equals no debt in the eyes of the law.

If some stranger owed you £2000 and they had managed to avoid you and not been paying back, would you be all happiness ans smiles if they thought I'd "rather not pay them"?! Just because its a company, they're still run and staffed by people with mortgages to pay for, children to feed.
