    So the issue is that if we end up selling and the new house is pushed back would we incur the ERC ?

    Potentially yes but possibly no.   The lender should be able to verify.

    Tried speaking to lender today, after various departments and being put on hold I am no closer to finding out. Will try again tomorrow
