Moriarty Law

Hi,
I have just recieved a letter from Moriarty Law relating to a unpaid car insurance debt of £160.35. I found an email advising that the monies I was due to pay was £110.35. This is dating back to 10th November 2017. Where do I stand? Moriarty Law are asking for £50 more than the original debt.

    Anybody can ask for anything so unless the contract (the insurance) specifically states that specific amounts are payable for delinquent accounts, then it is all up for discussion. 

    What did the insurance contract say about non-payment.
    • All land is owned. If you are not on yours, you are on someone else's
    • When on someone else's be it a road, a pavement, a right of way or a property there are rules. Don't assume there are none.
    • "Free parking" doesn't mean free of rules. Check the rules and if you don't like them, go elsewhere
    • All land is owned. If you are not on yours, you are on someone else's and their rules apply.

    This is what the email says

    We are writing to advise that there is an outstanding balance due following the cancellation of your Motor Insurance of £110.35.  (We must advise this amount may be in addition to any balance owed to Close Premium Finance).

    However, this dates back to 17/11/2017. The thing that is confusing me is that they said they have tried to email me, when they have not. They email states £110.35 but Moriarty Law are wanting £160.35.

    Insurance is a contract. All contracts have terms which explain what is owed when the contract is stopped early (technically compensation for a breach of contract.) 

    The contract will also have a dispute mechanism if the parties disagree and if the contract is silent on the matter, then small claims court is the arbiter.

    What you do not do is to believe what a third party tell you unless you have verified by reference to the contract, the details of the two items above.

    Or you can, if you wish, believe ML to be fine upstanding citizens who would never lie - and pay the £160.35

    If anyone can take a look at this? I spoke to the Moriarty Law, they said that they don't know why the extra was added on and that it can take 60 days for a response but to still pay them in the mean time.

    Galloglass has shown you the route to take, check the terms and conditons of your insurance policy, if you no longer have it, check the insurers website, each policy is likely to be subject to the same or similar terms, these should be on their website.
    If your not happy to pay it, wait for them to conclude their investigations, dosen`t matter what they suggest, all they want is your money.
