Cabot sending someone round. Unenforceable debt

I’ve just received a letter from Cabot informing me that they will be sending Resolvecall to my home. I have not been paying as after sending a CCA request, they confirmed that the debt was unenforceable. What do I do? They want me to call them within 7 days or these people will visit me.

  • Just to add I made a settlement offer just after being told the debt was unenforceable which they declined so I told them that I would no longer be sending payments as I wanted to concentrate on my enforceable debt first.

    Legally they cannot send anybody to your house, they arent bailiffs so, in writing you need to tell them clearly that you will not allow anybody in to your house and that you are withdrawing permission for anybody to visit. If somebody comes, regardless of what they say, call the police. Unless they are court appointed sheriffs they have no right to be admitted to your property (i would guess there is a template letter somebody could point you to) 
    Either email with  read reviept or send signed for recorded by mail. Dont fret, jts bully tactics to try and scare you in to paying.

    Your mistake was offering a settlement when the debt is unenforceable.
    Advise them to remove all your contact details from all their systems.

    No, they have every right to keep contacting you for payment - because whilst its UE doesn't mean its written off.  Usually, when they realise they are not going to get anywhere, the DCAs settle down and all you will get is the odd statement and gentle nudge to contact them to agree a repayment plan from time to time.

    I have to admit I've no experience with Cabot - but sounds like they are being a little persistent here.  All you should do is remind them the debt is UE and if someone from Resolvecall knocks on your door, tell them to go away.  They have no powers of entry.  You may find its an empty threat - but if not, just hold firm and make your position clear.

    No one will be knocking on anyones door yet due to covid-19.
    Plus the guys an gals at Resolvecall (the last doorstep knocking DCA i know of) are just self employed collectors, who are paid by results, they will be feeling the pinch as they have not been able to work since March, simple stratagy for dealing with them, is don`t answer the door, tell them to go away very polightly through the letter box.

    Or, you could film them and stick it on Youtube, some people do that, they don`t like it much, what they tend to do is target an area with a lot of debtors, to maximise potential profit, these are usually inner city areas, or large towns, if you live in the sticks they definatly won`t be coming, spending hours looking for a house in the middle of no where, and not getting paid, simply won`t happen.

    Plus as already mentioned, the law on this is quite clear, to visit someone at home, a company must first make an appointment, they can`t just rock up, unanounced, you can write and remove their rights of implied access, much like the postman has, do that, put a note on your door that you wont be answering, and if they call, just ignore, they wont stand outside for long, as time is money to them.

    99% of the time, this is just DCA bluff to "panic" you into paying up, they are the masters of if`s, what`s and maybe`s, Cabots tactics are all fairly old hat, well worn out, all quite long in the tooth and getting a bit boring nowadays.

    They don't half put stupid stuff in their letters.
    • All land is owned. If you are not on yours, you are on someone else's
    • When on someone else's be it a road, a pavement, a right of way or a property there are rules. Don't assume there are none.
    • "Free parking" doesn't mean free of rules. Check the rules and if you don't like them, go elsewhere

    Tell them you've got a bit of a cough though.

    It seems there were a lot of the Resolvecall letters sent out by Cabot over the weekend as all my clients got them.

    Resolvecall are going to be busy.

    my wife who is currently shielding due to medical condition and age also received such a letter last week. What is interesting is that after applying for a SARS and CCA (very useful advice) we were informed that the 3 historical debts (10+ years) were unenforceable due to lack of evidence :)..so she immediately stopped making the usual monthly payments since getting this information. Before the most recent letter about sending a caller to our house she was also informed of how much she had already paid back on all 3 debts....this to my surprise came to almost £4k for debts which I am sure were bought by Cabot for pennies many many moons ago!!...so I consider they have had their pound of flesh but no more. What a pity we the many  victims of debt can never get any idea of how much our debts were/are  sold for so we can then make realistic decisions about what is a fair and just repayment.....any campaigns to have this looked into?
