What happens to arrears?

I have been recieving CSA since 1998 through deduction of earning. There has been many issues with this including my ex husbands employers sometimes not sending this money through for 8-10 weeks and I ahve alwasy been owed arrears at one time £1200 but had almost all been caught up when in June this year once again employer starting making excuses, cheque has been sent, must be lost in post among other excuses. By August and after daily phone calls to CSA I got June , July and August money but was still a little arrears owed. Septembers money was recieved in October and have had no more since.

I know from my children that my ex is off work ill, I am not disputing this but am so angry as it took 6 telephone calls last week to get someone from CSA to confirm for me that I would NOT be getting any money due to my ex being ill. Although I do now speak to my ex after almost 9 years we do not speak about the CSA.

My CSA will be stopping in September 08 or before it as my daughter will be leaving school. My ex is likely to be off work for 6-9 months if he goes back at all.

Does anyone know what happens if there are arrears owed when a case is closed? If he is still ill when daughter leaves school he will owe about £3k and to be honest I am thinking of just asking CSA if they will close case now, can I ask them to just wipe any arrears off?

If you have been claiming benefits (Income Support, JSAS etc. NOT Child Benefit or Tax Credits) you can't stop the case or the arrears because they are classed as being "owed to the Secretary of State" (and bearing in mind that he's just admitted fiddling his expenses for his campaign for Deputy Leader of the Labour Party he might need the money now!!). If not, you can tell the CSA to get lost any time you like and even tell them to forget the arrears.

thanks mr green , no have never claimed any benefits so will give it a few more weeks to see if any news of him returning to work and if now will ask for case to be closed
