I own a property with my x-spouse who I am divorcing. I'm buying a new property with my new partner. I'm confused over the percentage of stamp duty I will need to pay. Also if I have to pay the higher rate, can I claim it back once my property is sold or my x buys me out? Thanks

Not sure if your new partner is a first time buyer how it works but stamp duty has to be paid upon completion, so before you pick up keys1

Yes, you are correct. You pay the additional 3%, but can claim it back if you sell your original home within 3 years.1
