Joint accounts in Bankruptcy

Options
Hello!
I was dead set on an IVA, but looking at it closer I would be better off my bankruptcy. I will probably go bankrupt in a few months time.
I have a joint account with my husband that has our joint expenses that come out of it. What I would like to know is:
A) If I go to the bank in the next few weeks and take my name off it will it still be frozen?
B) Should we start putting our utility accounts that are just in my name in his name?
Thank you!

Only accounts with your name on them at the date of the bankruptcy order may be frozen. Presumably there is not a significant amount of cash in the joint account? Otherwise the OR would be concerned that you have effectively “given away” your share of the money by removing your name from it. (And I don’t mean the sort of amount that covers household bills, I mean an amount that is over and above that).

Are you in debt with the utilities providers?

It's best to have your own account.

  • Thank you! We both have our own accounts but pay into a joint account for household expenses.
We don’t have any arrears to our utilities.
