Annual Leave/Holiday

I am fortunate enough to be receiving full pay whilst off work during this time, as my role is not safe to return to work yet. My issue is that I have two weeks of holiday allocated to me which fall during this time off. Normally we would be able to move these weeks if there was space to do so but there is no room left due to everyone moving their annual leave about. Therefore I have been forced to take these holidays although I am not at work, so I’ve technically lost these holidays. Other employees in my same role and position, so are also currently on full pay and not at work, who have their annual leave later on in the year are not affected by this, so are getting 2 weeks more off than myself which I think is unfair. I have asked my union a few times about this issue but don’t seem to get anywhere and my depot have been told there is no room to move these allocated weeks. In total I have lost 17 days so far of my annual leave, as I have also had days taken off me for bank holidays.
Where do I stand in trying to get back these days that I have lost? I wouldn’t mind losing my annual leave if everyone else lost theirs too, but I don’t think it’s fair that some people lose theirs and some people don’t!

You’re getting paid your full salary and not working. Seems quite generous as they could furlough you on 80%

Technically you’ve not lost these days. You are just taking them when you’re not in work!

I agree, I am very fortunate but my issue is more so that other people in the same role as me are getting more days off in the year than I am, everyone should be getting the same? So they are in the exact same position as me now, off work and being paid in full but also get an extra 2 weeks off later on the year.
People in other depots are also able to move their annual leave to later on in the year as they have room to do so, it is just my depot that is unable to do it.

    Without being ‘harsh’ it’s tough.

Your employer could require everyone to take their holidays whilst off on furlough.  You just happened to have some
booked during the pandemic and other people didn’t. They don’t have enough staff for you to be off later. It’s tough.

Thanks, I guess there’s not much I can do. I know they’ve technically not done anything wrong. It is just frustrating that some people were able to move theirs to later on in the year and other people couldn’t. I would have liked it if it could’ve been fairly and equally for everyone!

There is no "technically" about it, your employer has done nothing wrong. They are in fact an extremely generous employer. Please note that employers have no obligation to treat everyone fairly and equally, so two employees doing the same job do not have to be paid the same nor have the same amount of holidays. They are only obliged not to discriminate because of a protected characteristic
