I was thinking of unenforceability under the Consumer Credit Act. but that is an apparently valid agreement dated 21/6/12. You did say 'his entire credit card statement dating back to 2011'
If you're happy that this agreement is for that card despite the date anomaly, then the whole thing is valid

Yes, you can go the token offer route but it will take 2933 months to pay the debt.
You could combine that  with a settlement offer at £750 if you have the cash and no other debts
    Thanks :)

The 2011 was a typo, it was meant to say 2012 so I'm unfortunately convinced it's the right one. How would we go about convincing them to accept a settlement offer? We don't have the cash at the minute but we could get it in a couple of months.

Thank you so much for your help everyone, it really is appreciated.
  • I had a historical default back in 2016 with Very that was sold to Lovell. Direct debit didn't switch when I changed current accounts, stupidly, I didn't check. Letters from Very were going to my mums house and I was at uni and she didn't tell me I had post. Very never contacted me by phone else I'd have known.
As soon as I realised what had happened I contacted Lovell and they were actually fantastic. I cleared it within 2 months and they actually fought Shop Direct (Very) on my behalf to have the default removed (apparently it is the original creditor who can only do this? Not sure how true this is).
Give them a ring, your partner has to face this, it is a debt he owes, but they were good to deal with so I'm sure they'll be accommodating.

Last week i made full and final settlement offers to Lowell and they were accepted.
As others have said you can set up a payment plan for any amount on their online portal, actually set up my 4 accounts with them for 1p per month which was allowed.
But in an effort to close the accounts i emailed them saying for the 4 accounts (totalled around £800) i can pay £25 for each of them to close them. They accepted extremely quickly so now its all good, paid the £100 and thats it done.

That's a settlement at 12.5 p in  the £. They must be desperate.

    Fill your boots, guys.

The below is what i settled for, i did a blanked £25 per account but if they were prepared to take a 17% payment of the £437 then they probably would have taken much less for the lower value accounts.
Either way im glad its done with them.
