Debt company chasing me

Hello everyone, fantastic website.
looking for advice regarding a company called Shoosmiths who have sent me a letter regarding £1700 on an unpaid credit card. I stay in Scotland and they are threatening me with all kinds of actions, eg wage arrestment,freezing my bank account etc. I suffer from severe mental health and also ptsd due to a life threatening stabbing incident 2 years ago. I stay on my own and due to work and health reasons I have not had a full weeks wage for over 9 month and that was the reason I couldn’t keep up with payments.

Any help would be appreciated

    Sorry to hear about your personal circumstances.

    Shoosmiths are a law firm, who I assume are acting on behalf of one of your creditors.

    Did you call the CC company to let them know of your circumstances?

    Sure others will be along shortly to give more detailed advice.

    It may be a pre-action letter, the letter sent before a claim arrives. In Scotland there is no formal pre-action protocol (PAP) which sets out the formal steps, so you may get a claim in the next month, but it is not certain.

    Would suggest you call your local Citizens Advice or legal charity to get them to check the letter. They ought to be able to tell the difference between Shoosmiths acting as simple debt collectors (not regulated) or as lawyers (regulated). Legal firms switch between the two and if can be difficult to tell if the letter is all hot air, or a serious issue. 
    • All land is owned. If you are not on yours, you are on someone else's
    • When on someone else's be it a road, a pavement, a right of way or a property there are rules. Don't assume there are none.
    • "Free parking" doesn't mean free of rules. Check the rules and if you don't like them, go elsewhere

    Either way you should still send the provit letter to them, it will at the very least, slow them down somewhat.
