Named Joint Mortgage

Need some advice please.
I have a joint name mortgage with my ex-girlfriend which we took out 4 years ago now, she moved out 2 years ago and she was paying half of the mortgage which was £280 per month, I have been paying the mortgage myself over the past 2 years, if I ask her to remove her name off the mortgage, would she been entitled to any money for the 2 years that she paid half towards, she also didn’t pay any deposit in the beginning when we took out the mortgage. Thanks for any advice.

I think technically speaking she'll have some equity in the property if she has been making half the payment - not sure how the legality of it all works but if she also paid nothing towards the deposit then it would negate/outweigh probably the payments she made over the two years.
Is she trying to claim that you owe her money for this? I wouldn't think she'd have a leg to stand on if you've got proof that you funded the entirety of the deposit and you've continued paying 2 more years worth of the mortgage than she has. (could be totally wrong, but that's how I would see it anyway!)0 -
Did you have a declaration of trust drawn up when you originally purchased the property?0

No, I wish we did.Thrugelmir said:Did you have a declaration of trust drawn up when you originally purchased the property?0 -
Hopefully you've remained amicable terms and can come to an agreeable solution then. As the alternaive is potentially expensive and time consuming.
I'd always say that while your ex hasn't contributed to the mortgage she's had to pay to live some where else.0
