Leaseholder gardens

Myself and my husband are in the process of completing a right to buy on our leasehold ground floor flat
we have been approached by the guy that lives in the flat above us asking if we want his garden as he does not use it (it’s covered in brambles)
how would we go about getting use of this and if we did could it be taken back if he sold his flat ?

Does the guy above rent his property? Or own the lease? Although in either case he could not transfer to you, only the freeholder could do that.I am not a cat (But my friend is)1
