CCA re bank account debt

Hi, Apologies if the answer lies elsewhere but I couldn't find it. I am sending CCAs requests to debts originating from credit cards but how about a bank account overdraft that was included in a DMP. Is that the same?

Hi,

The act applies to most types of regulated lending, cards, loans, etc, and although the act covers overdrafts, the right to have a copy of your credit agreement does not apply to them except under certain circumstances.

It is a gray area, and you would need legal advice to fully appreciate your position.

As Sourcrates states above, overdrafts are not covered by the CCA regulations.

But if they cannot produce the required documentation, how will they know the debt is for an overdraft?

It's worth trying.
