Selling a home after bankruptcy

My partner and i divorced 8 years ago and i went bankrupt in 2012 as the house we had together was in £100k negative equity.  My partner now wants to sell the house and my name is still on the deeds.  Do i have to pass my part of the house to the official receiver as the house was part of my bankruptcy? Also am i legally obliged to have to pay anything to sell this property ? Thanks

    The IR had 3 years to deal with the house, after this there’s nothing they can do, given it’s 8 years now I don’t see any issues. It would be worth making sure your conveyancer/solicitor is aware as there might be slightly more paperwork 
  • Will do thanks. I dont want anything to do with the sale and certainly dont want to have to pay for it to be sold as i havent stepped foot in the place since 2009.  As my name is on the deeds i have to agree to it which i have done but apart from that im not bothered if its sold or not.

    You *should* have had a letter from the Insolvency Service informing you that the property “revested” in you. 

    I’m curious, after 8 years is there still negative equity?
  • Yes i got the letter. Yes £70k negative equity but i was told my share was always covered under my bankruptcy.

    It is, yes. It’s known as a contingent liability and the debt crystallised when you went bankrupt so you owe nothing now. I don’t see how you can be forced to pay any legal costs of the sale.
  • Thank you. They have sent me paperwork from his solicitor but i wont be agreeing to pay anything.  i think he is happy to pay just to get it sold as he is now remarried.
