    I expect the loan was originally given as a gift, because motgage companies don't like to see deposits paid with loans, so they wuld have had to sign something to the effect that the loan was in fact a gift. So legally, there's no wrongdoing there. The other part about the house dispersal is going to have to be covered by the divorce courts.
    Morally, I think keeping your kids housed trumps a !!!!!! off in law or husband who don't seem to be able to grasp that children trump pretty much anyones ire about something else.
