Job not advertised and given to inexperienced person

Hi
I have worked for company for last 18 yrs and the last year I have worked in different  dept. I was told by my boss that there would be a new senior role above me starting next week from another dept. They had to find this employee another role due to him unable to work in his current position due to health reasons and our dept some months ago had this vacancy available but it was not filled and the vacancy was taken down. I have been asking about this senior role and working towards getting this and now they have given this role to someone who has no experience without advertising it out formally. Can they do this ? I feel hugely angry that this person has been just given this role without doing anything just because they had find other work for him. They say he has man management experience which is why they gave him job . I am expected to train him am I being unreasonable here

Yes there is no obligation to advertise any roles - some exceptions are parts of policy agreed in public sector, not not a matter of law.

    Yes you are being unreasonable.

They could literally hire someone above you, to sit on their phone all day if they so choose.

Happens all the time, especially with redundancy situations. People get redeployed above their usual grade etc.

    You are being unreasonable.

You’ve been only working in your department for a year so don’t have much experience yourself. If this person has come from a management role somewhere else in the company then they do have more experience than you in the role they are being given e.g, managing you.

You're being understandably annoyed, but if you think it through, what realistic alternative did your employer have? You weren't offered the post when it was advertised some months ago, which means you either didn't apply (so entirely reasonable that your employer gave it to someone else) or you did apply and weren't suitable then, so presumably aren't magically suitable a few months on.

I see little wrong here. In fact, it sounds like the company have been alright in finding someone with a health issue an alternative role as opposed to basically sacking them! It's just life! If you want this promotion in the future then make some moves. It does sound like you were making moves, to be fair, but you have to gauge that sort of stuff because some employers effectively have zero interest in promoting you at ANY POINT in time. It's just a carrot dangling exercise to keep you motivated.

Don't take it out on your colleague, but rather have a think about why YOU aren't in that position right now. Some honest soul-searching. May be you, may be the company, may be the fact that this job was created for the person and there was otherwise no plans to introduce it. I will just caution you (because I've been on both ends of this before) that being a bit funny with your senior during the training process MAY backfire on you in the long run. It probably isn't their fault that they got the job over you.

One possible (but insanely unlikely) avenue to explore is whether the person has a disability, and whether they have been treated more favourably as a result of this ("positive discrimination"). Maybe worth reading up on it at least, but I think there's almost zero case for that here because it all seems so reasonable from the employer (so EVEN IF there is such discrimination, it may have a perfectly valid justification).

Uhm no, it's not a carrot dangling exercise. Business actively want to promote competent people into higher positions.
I do agree that the OP should self-evaluate though.
The person having a disability or not, doesn't affect the OPs legal position in anyway. People with disabilities are treated more favourably, the law to some degree requires that; which is why reasonable adjustments might be made for someone with disabilities. Those adjustment are generally favourable treatment.

This person does not come from a management role in the company he was same grade as me now just in a different dept. He apparently has man management experience in a previous role but could we all slightly stretch our CV to include experience that would be applicable to what the employer wants to hear. I have been actively asking and working towards this role since it was last advertised and am going to find it hard to take  he has done nothing to get this position

I dont understand what the issue is. For whatever reason it was decided you are not suitable for the role. Doesnt matter how hard you've worked, it's a decision out of your hands.

You can remain professional, or you can find a new job.
  • They might well flop out! you just never know. Keep positive.

He obviously has done something or he wouldn't have been given the role in preference to you. You may find it hard to take, but that would be the case even if you felt he had done something rather than nothing. Being peeved about it isn't going to help your career or your emotional state one iota.

You are ignoring the fact that for whatever reason, your employer didn't see you as a viable candidate for the role - have you asked why? Personal qualities are often just as important as experience.

    Ok. I'll say it "Nepotism".
