I’m hoping someone can help as I’m struggling to get a definitive answer anywhere. 

Since going on Shared Parental Leave means curtailing Maternity Leave, does this mean that my 13 weeks that I’m required to return to work if I take Occupational Maternity Pay starts when I go back to work even though my husband will be going off?

Example: I go on maternity leave September for 36 weeks and go back to work in May. Does my 13 weeks start in May (end of Maternity Leave but start of Shared Parental Leave) even if my husband is then off from May until September?

Your husband would not normally be paid May to September under Shared Parental Leave as there is normally no pay in the final 13 weeks (unless his company does this voluntarily, which his very rare).

If I'm reading your question correctly then it is entirely down to your employer, so you really need to check with them and get the answer in writing.
