On the Payroll or not?

Hi Everyone,
I am wondering if, in the rules of HRMC, I have still been on the Payroll in February?
My redundancy letter was given to me on 22nd January. I was issued with the following documents: 

  • Payslip for January 2020. This will be in your bank account on Friday 31st January
  • Payslip for February 2020.This will be apaid into your bank account on 29th February
  • Your P45 reflecting both January and February payment but reflecting a leaving date of 22nd January.
It would be great to clarify that as with the recent guidance from the Government my ex-employer could rehire me and put through the furlough scheme.

  • Yes you are on their payroll until they end you. Its a technical issue- and yes you can be rehired after redundancy with your agreement. But remember in these cases it is likely they wont pay you redundancy.

    I'm not sure that's the case here, when OP says the leaving date is clearly stated as 22 January. Sounds like they were given pay in lieu of notice, rather than being put on gardening leave - perhaps OP could clarify?

    OP, whatever the answer to that question, I'd contact your former employer and ask if they would be willing to rehire and then immediately furlough you. As SS says, you are likely to have to repay any redundancy payment you've received.
