PCN from Premier Parking Logistics

Hello, I have read many posts about this company and I am now confused on what to do. I got a PCN on the 20th January at Shaws Passage in Birmingham City Centre. The reason was for not having a ticket and this was because the ticket machines were not working. I noticed other vehicles were parked and had left a notice on their dashboard saying the ticket machine is not working so I did the same. They never had a PCN on their window and I did which was strange. I appealed it and never got a response from them. I received the Notice to Keeper on 6th March. I emailed them again asking why as I appealed it and their response was, 'I didn't put my home address in the original email.' I even mentioned about the other vehicles doing what I did, to which their response was 'no further correspondence via email.' 

Personally, I don't really fuss over private parking charge notices. On this occasion, I wasn't in the wrong which is why I am trying to contest it. What do i do? I have also come across (www. parkingfines. org. uk) who said they can remove it for a £18 charge.

If you cannot pay you cannot form a contract.  If there is no contract you cannot be in breach of it, read this

AFAIIA, there is no requirement in Contract Law for you to tell them, (and the world) your home address.  If they are daft enough to take this to court they will crash and burn imo, so challenge them to go there. 

Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

Thank you for the response. I'd like to add they did send me a picture of their machine where it says some thing about the machines not working then you shouldn't park here. It was in the tiniest bit of writing though and very hard to miss when in a rush. Apart from complain to my local MP, what else do I do in terms of any further letters they send? According to reviews, I hear they are a very difficult company to deal with.

You do not need a company to beat PPL and Walton Wilkins.

Some of the self-styled appeals companies - not that one - are shockingly aggressive and IMHO, worse than PPCs.  Trustpilot needs careful reading first.

Nothing else needs doing at the moment, and a company won't be able to appeal further.  You've already appealed. You got the inevitable knockback, from the scam company.

Ignore any letters from PPL

Ignore the two letters that will follow from DCBL

Send them a letter and keep proof of posting, if you move house as they MUST have your current address.  Come back if you receive a letter from Gladstones.

Oh, and STOP just paying private parking tickets.  They are never justified.

Walton dispite his reputation in the local area as an ex clamper is easily dealt with and does very few court claims

Thank you for this. I will just ignore them. In terms of tickets, if you mean PCN's this is my second one ever. Did not pay the first which I received early in 2019. Not heard back from them yet. That was an anpr one. If you mean tickets to pay to park, how's that possible? How would you contest something if you purposely don't pay for a ticket?

My apologies.I should have re-worded that better. I meant don't fuss as in if you see one on your car and respond like, 'yeah whatever' as opposed to a council fine.
