Bank holidays and part time worker

    I'm working the may bank holiday Monday and they're giving me a day in lieu in that week. If I do take that day, does it come out of my leave which includes pro rata hours for bank holiday. I'm so confused. I understand if I don't work one it does get deducted, if I do then it doesn't.  No one seems to understand at work either.  

    We get 25 days and 8 bank hols. I get a percentage pro rata.

    We used to get paid and not get a day off or an extra days holiday. I think because they've now decided that they don't want to pay or don't have the budget, the day in lieu is maybe a sweetener.

    It depends on your employer's own rules Laura, you would have to ask HR. 

    A simple day off in lieu is just that. Work one day and have another day off instead which is classed as one of your bank holidays. Your firm may choose to give you an extra days holiday as well but that would be the 'sweetener' not the day off in lieu.

    Indeed.
    As I said earlier, if a firm gives more than the statutory minimum holiday (five days more in this case for a full time employee) they can attach pretty much any terms and conditions they like to those extra days.


  • Hi. Our company have 2 part-time workers: ‘A’ works Monday and Wednesday, ‘B’ works Tuesday and Thursday. They each work alternate Fridays. Full-timers are entitled to 28 days (inclusive of BHs).

     2020 BHs have fallen on every working day for ‘A’, resulting in ‘A’ not having the same flexibility as ‘B’.  'A' has had to use 8 out of their 14 days as fixed leave, and ‘B’ has been able to flexibly book all 14 days.

     Is this fair?

    Please help.  Thanks (and apologies if I've not posted in the correct place!)

    Not really. However it is legal. What would they like as a resolution?

    They each get the same no. of days off but B has more freedom about when. It's not unfair, given that bank holidays have no special status in employment law. 

    Where I used to work, people in A's position would sometimes work an extra day in a BH week to give themselves back that day as leave.

    Its legal and fair. It's the same number of days off for the same pay. 
    Some people value flexibility whilst some others value specific times off. I know someone who would think it's unfair the other way because they have to work their full working week during bank holidays whilst others get a day off.
    If it's that big an issue then either change shift patterns or change jobs.

    For myself, I work a three day week. The last three xmas's I haven't had an extra day off because my normal working week were days the warehouse was open. This year I only have to work one day Xmas week, which is a good Xmas by most standards. 
    I could name the three individuals who will be in the shift managers office complaining about it right now if I was so inclined.
