HFC, Court and additional charges.

Hi all,

As you can see finally dealing with my debts and on a DMP with CCCS and paid off a good chunk!

However... I have received court papers today from HFC but I am a little confused...

It states that the default balance is £8105.53 - I have been paying to this account and therefore I believe the balance is less than this - anything I can do?

They've also added a collection charge of £1351.19 to the account along with Court fee of £190 and Solicitors costs of £100.00

Is there anything I can do about the additional charges or shall I just accept it and put it down to experience?

It also doesn't state whether it's a CCJ they're going for a Charging Order - how would I know?

    If HFC are the same as they used to be, they've still been applying interest.

    Assuming that this is part of your DMP with CCCS, then I think that the first thing to do is contact them (CCCS that is). They should be able to provide you with a statement of the account along with any interest charges being applied. If they haven't seen the letter, then it would be wise to get a copy to them as soon as you can.

    They will also know what to do about any pending court action (assuming that is not just HFC trying to pull a fast one!!)

    The court costs and the solicitors costs are something you can not dispute - but on the CCJ forms - there is part of the where you can admit the whole amount or only part of the amount.

    If you do the latter you will have to supply defence as to how much you believe you owe.

    It may be that the excessive charges applied by HFC will have to be argued / defended in court.

    As earlier poster have said - discuss it with CCCS as soon as.
    I am a debt counsellor working in the voluntary sector - we don't charge our clients for the work we do!

    With regards to the outstanding amount I'll see whether HFC will provide me this or not.

    I'm not sure why you think CCCS will have this information - they're just managing the repayment plan not the account itself, are they even making payments on the OP's behalf ? If not they can only advise what the original repayment schedule was.

    Go back to HFC and ask them for the information - they're the only ones that can provide the accurate information.

    As I said, if this is part of your DMP with CCCS and you pay them monthly and CCCS then pay your creditors, they will be aware of both what has been agreed with HFC and what payments have been made. It is not unknown for a creditor to get their records wrong.

    CCCS can also provide good advice on what to do when there is a court action is pending. It's a freephone call, so what harm can it do?

    I have spoken with CCCS this morning and with the creditor. It does look like payments I have been making haven't been deducted from the amount on the claim form.

    The creditor also stated that she can't understand why the solicitor has gone for a CCJ as I advised that the payment would increase in the next 6 months so she was going to contact the solicitor for me regarding this and the outstanding amount and someone should come back to me with further info.

    After speaking with CCCS I have prepared the acknowledgement part of the form which is going to be sent back to the court today to advise that I intend to dispute part of the claim. I am also going to ask for a breakdown of their collection charge - the debt is high enough without more than £1000 being added for charges - nothing ventured nothing gained.

    Fingers crossed and we'll see what happens.
