Condition of mortgage

I’ve just had the mortgage deeds returned from my solicitor and on it there is a condition that I clean some outstanding debt before or on completion. Well I’m using equity to clear this after we complete. How does that work? Any help will be great as it’s late and I’m worried! Thanks

  • As in demanding they are paid on the completion day? Do I need to send a statement to him after I pay? The deed says: 

    “Your lender requires confirmation that the following creditor: 
    Halifax £5300
    Are repaid upon or before completion”
    “please confirm this debt will be repaid”

    Then I just have to sign the deed. Not asked for anything else

    "On completion" includes "immediately after completion", obviously it can't be instant. Unless the solicitor has actually been asked to check (or to make the payment themselves), no they won't check. But if you're going to do it anyway does it matter whether they check or not?
  • I do, I just mean do I need to provide a statement on completion day, but tricky to juggle isn’t it

    Just ask your solicitor. Worst case scenario is that they make the repayment directly, and then they can hand on heart say to the lender the condition's been fulfilled. But in my experience the lender just takes you on trust to sort it out.
