Finance company has claim against Mortgage for loan never taken out, advice please?

We are looking to move and have spoken to our current mortgage provider, they have advised that we have a debt secured against our property. We have researched and discovered that when we looked into consolidating our debts nine years ago the company put this against the mortgage even though we did not take out a loan. The company are being very slow at rectifying the situation, I am unsure where to go legally to get this resolved. I really would like to buy the new house! Any advice would be gratefully received

@JennieAnn Just to be clear, so you started an application for a secured loan 9 years ago but aborted midway, i.e. never actually took out the loan. The lender had by then put a charge against your house which only came to light now that you are looking to sell.
Is that correct?
If so, the first step is to file a formal written complaint with the lender (check their website or call them). Make sure you mention that if they don't resolve the issue within 8 weeks, you will go to the ombudsman. If the scenario is as described above, it will be resolved but it might take some time.
Don't waste time doing anything more before you file a formal complaint and get the clock ticking.2
