Entry Terms and Conditions

By submitting an entry (your “Entry” and other derivatives of the same) in order to take part in the Ant and Dec’s Saturday Night Takeaway (Series 16) (the “Programme”) feature provisionally entitled as the “I Want a Place On The Plane Poster Feature” (the “Feature”) at www.itv.com/poster or www.stv/tv/poster (“Websites”) you hereby agree to the following terms and conditions (the “Terms and Conditions”):

1. GENERAL

1.1. ITV Studios Limited of 2 Waterhouse Square, 140 Holborn, London, EC1N 2AE (“we”, “us”, “our”, the “Promoter”) intends, but does not undertake, to produce the Programme for initial transmission by ITV (the "Broadcaster"). It is our intention for the Feature to be incorporated in selected episodes of this series of the Programme.

1.2. These Terms and Conditions form part of your Entry to take part in the Feature.

1.3. These Terms and Conditions may be amended at any time without prior notice. Any changes will be posted on the itv.com website. It is your responsibility to ensure you review these Terms and Conditions before submitting an Entry, and we recommend that you print and store or save a copy of these Terms and Conditions for future reference.

1.4. We do not represent that we will produce or broadcast any episode of the Programme or to include your participation in the Feature and/or Programme and/or include the Feature in every episode of the Programme.

1.5. Our right to terminate or modify the Feature and/or the Programme at our sole discretion is strictly reserved.

2. HOW THE FEATURE WILL WORK

2.1. During a broadcast of selected episode(s) of the Programme we will announce our intention to include the Feature in a particular episode of this series of Programme (we will refer to this as an “Announcement”)

The number of episodes of the Programme in which the Feature is included is to be solely determined by us.

The episode of the Programme in which we intend to include the Feature shall be referred to as a “POTP Poster Episode”).

2.2. In the first Announcement we make in this series of the Programme, we will invite viewers who meet the Eligibility Requirements (as set out in Clause 3 below) to get a Poster (as defined in Clause 2.3 below) and follow the instructions on the Websites to register to submit an Entry for the Feature.

In any subsequent Announcement made during this series of the Programme, viewers who meet the Eligibility Requirements and who have not already submitted an Entry will be invited to get a Poster and submit an Entry for the Feature.

PLEASE NOTE: If you have already submitted an Entry during any prior Announcement and you are not a Winner of the Prize (as such terms are defined below) your existing Entry (to the extent it is compliant with the Eligibility Requirements) will remain eligible for all remaining POTP Poster Episode(s) that are included in the Programme.

2.3. An official “Ant and Dec’s Saturday Night Takeaway – I Want a Place on the Plane!” poster (the ‘Poster”)can either be:

2.3.1. picked up for free, subject to availability, at your nearest Virgin Holiday Store – see https://retail.virginholidays.co.uk/retail-appointments/; or

2.3.2. downloaded to print from www.itv.com/poster or www.stv.tv/poster..

2.4. You will need to place the Poster with the main Poster image facing out of a “Window” (which shall mean an opening in the wall of a fixed address which is fitted with glass or other material (such as Perspex) in a frame to admit light or air which allows people to see out of it; or such other wall opening that we can reasonably deem to be a window) at the fixed address you set out in your Entry (your “Address”). The Poster image you place in your Window needs to be visible from the outside.

Please note, for the purposes of the Feature we can only consider:

2.4.1. 1 (one) Entry per Address (with a valid mobile phone number) for this Feature; and

2.4.2. Entrants who live at a fixed UK address;

To the extent you put up more than one Poster in Window(s) at your Address, you are welcome to do so, but please be reminded that you are only permitted one Entry per Address (with a valid mobile phone number) for the Feature.

2.5. Whilst you are encouraged to keep the Poster visible in a Window at your Address for the full 5 weeks in which we could include POTP Poster Episode(s) in the Programme (so between 22 February 2020 up to 28 March 2020) in order to be an eligible for a POTP Poster Episode you only need to have the Poster in a Window at your Address on the Wednesday preceding any date of the POTP Poster Episode referred to in any Announcement provided you meet the Eligibility Requirements and have submitted an Entry and if you are declared a Provisional Finalist (defined in Clause 2.6 below) to have the Poster in your Window during the live broadcast of the relevant POTP Poster Episode.

2.6. On the Wednesday preceding a POTP Poster Episode, the details of 10 (ten) randomly selected names will be chosen from the all Entries made up to 3:00pm on such date by ITV Consumer Limited (the “Shortlist”). The allocation of the Entries on the Shortlist will be as follows: the first Entry randomly selected would be first on the Shortlist, the second Entry randomly selected would be second on the Shortlist and so forth until we have 10 (ten) Entries allocated against the 10 (ten) places on the Shortlist.

Following delivery of the Shortlist to us by ITV Consumer Limited, we will then contact up to 10 (ten) of the Entrants on the Shortlist in descending order of how an Entry appears on the Shortlist, on a withheld number on the phone number (or other method of contact (if appropriate)) provided in the Entry, calling 3 (three) times in a 2 (two) hour period from 4:00pm to 6:00pm. PLEASE NOTE: There is NO GUARANTEE that we call all 10 (ten) Entries which feature on the Shortlist.

If you are in the Shortlist and we call you and you cannot be reached and/or we are unable to make successful contact with you following the fixed time periods as specified and/or if you fail to meet any of the Eligibility Requirements and/or are otherwise unable to comply with these Terms and Conditions we reserve the right to withdraw you from contention for the Feature (without further liability to you) and to contact the next Entry from the Shortlist until Entries which meets the Eligibility Requirements are established.

The first Entrant from the Shortlist who meets the Eligibility Requirements shall be deemed the “Provisional Finalist” with the remainder of those Entries contacted from the Shortlist which meet the Eligibility Requirements herein defined as the “Secondary Finalists”).

It is currently intended that we will award a minimum of 1 (one) Prize (as defined in Clause 2.8 below) in a POTP Poster Episode, but we reserve the right, at our sole discretion, to award more than 1 (one) Prize in a POTP Poster Episode and to the extent we elect to do this, the number of Provisional Finalist(s) shall be increased to correspond to the number of Prize(s) we decide to award in a particular POTP Poster Episode and such additional Provisional Finalists shall be determined from the Secondary Finalists in accordance with how they were drawn out and allocated on the Shortlist.

2.7. As a reminder if you are not selected as a Provisional Finalist for a particular POTP Poster Episode, please do not submit another Entry. This is because should a subsequent Announcement be made on the Programme for another POTP Poster Episode, your existing Entry, provided it meets all the Eligibility Requirements, will still be in with a chance of being randomly selected as a Provisional Finalist for any other subsequent POTP Poster Episode(s) we feature during the course of this series of the Programme.

2.8. Following the selection of the Provisional Finalist, on the days leading up to and including during the day of the broadcast of a POTP Poster Episode, we will then seek to validate the Entry of the Provisional Finalist to ensure that their Entry remains compliant with the Eligibility Requirements (which shall include the Provisional Finalist being present at the Address during the live broadcast of the relevant POTP Poster Episode). To the extent that an Entry which is the Provisional Finalist can no longer meet the Eligibility Requirements we reserve the right to withdraw that Entry as a Provisional Finalist and replace them with the next corresponding Entry from the Secondary Finalists list. The Provisional Finalist whose Entry does comply with the Eligibility Requirements will be revealed as a winner of the Feature (a “Winner”) during the live broadcast of POTP Poster Episode where the Winner shall receive a “Place on The Plane” holiday prize package (the “Prize”) to go Walt Disney World in Orlando, Florida for themselves and up to 3 (three) guests (the “Guests”) to accompany them. We set out in Clause 4 what exactly the Prize shall consist of.

2.9. If you are a Winner you agree, if so required by us, to be filmed and recorded in accordance with the provisions set out in Clause 6.1.

3. ELIGIBILITY REQUiREMENTS

You undertake that by making an Entry for the Feature that you meet the following eligibility requirements:

3.1. you are 18 (eighteen) years old or over and a UK resident;

3.2. only 1 (one) person per UK based Address (with a valid mobile phone number) shall be eligible to be selected as a Provisional Finalist for the Feature;

3.3. you have a Poster with the image facing out of a Window at your Address;

3.4. any Poster placed on a Window at your Address must be of at least A4 size (whilst it would be preferable for the Poster to be in colour, to the extent it is in black and white this will not have a bearing on your Entry);

3.5. you are not:

3.5.1. currently employed by and have not been previously employed by us, any of the ITV plc and/or STV plc group of companies, the Broadcaster, Virgin Holidays Limited, Virgin Atlantic Airways Limited, Virgin Atlantic Airways International Limited (collectively referred to as "Virgin") or The Walt Disney Company Limited ("Disney") or Roofoods Limited (trading as Deliveroo.co.uk (“Deliveroo”); or

3.5.2. a live-in partner or immediate relative (i.e. mother, father, son, daughter, brother or sister) of an employee of ours or the Broadcaster, any of the ITV plc and/or STV plc group of companies, Virgin, Disney or Deliveroo;

3.6. you have not already received free or complimentary “Place on The Plane” ticket(s) from us during the course of this series of the Programme whether in connection with the Feature or otherwise;

3.7. you are not a guest accompanying someone who is a recipient of free or complimentary ticket(s) for the “Place on The Plane";

3.8. you are free and available and have a valid passport to travel to Florida, United States on 3 April 2020 and return to the United Kingdom on 9 April 2020; and

3.9. to the extent that your Entry is deemed to be a Provisional Finalist that you will be present at the Address during the live broadcast of a POTP Poster Episode with the Poster facing out of a Window at your Address.

(the above shall be collectively defined as the “Eligibility Requirements”).

4. THE PRIZE FOR THE WINNER AND THEIR GUESTS

4.1. The Prize shall consist of the following:

4.1.1. up to 4 return ticket economy seats (the “Tickets”) for the Winner and their Guests on:

4.1.1.1. on a specially chartered Virgin Atlantic flight from London Gatwick via Manchester Airport to Orlando, Florida currently scheduled to depart on Friday 3 April 2020. The Winner and the Guests can choose to embark this flight at either London Gatwick or Manchester Airport.

And the return leg shall be as follows:

4.1.1.2. if the Winner and the Guests are London bound passengers, economy seats on a specially chartered Virgin Atlantic flight departing on Wednesday 8 April 2020 from Orlando, Florida and arriving at London Gatwick on Thursday 9 April 2020; or

4.1.1.3. if the Winner and the Guests are Manchester Airport bound passengers, economy seats being made available on 1 of 2 pre-scheduled Virgin Atlantic flights due to depart during the course of Wednesday 8 April 2020 from Orlando, Florida and arriving at Manchester Airport on Thursday 9 April 2020. Please note, that seats on the Manchester Airport bound flights will be subject to availability and to the extent that no seats are available the Winner agree for themselves and the Guests to return to the UK on the London Gatwick bound flight referred to above.

(individually referred to as a ‘Flight’ and collectively the “Flights”)

4.1.2. a holiday for up to 4 (four) persons for 5 (five) nights and 6 (six) days at the Walt Disney World® Resort with room accommodation consisting of 1 (one) standard room (which can accommodate a maximum of 4 (four) people per room) with 2 (two) double beds for 5 (five) nights at a hotel at the Walt Disney World® Resort selected by Disney in its sole discretion based on availability (but which is currently anticipated to be Disney’s All-Star Sports Resort);

4.1.3. return US ground transportation from Orlando International Airport to the Winner’s and his/her Guests’ resort hotel and return;

4.1.4. up to 4 (four) 6-Day “Magic Your Way Tickets” with Park Hopper and Water Parks Fun & More Option. Water Parks access is subject to rehabilitation, seasonal and weather closures. Green fees are for one round of miniature golf. Tee times required and are subject to availability and are valid for one round. Round must start prior to 4:00 p.m. Only one miniature golf visit per day. ESPN Wide World of Sports Complex valid only on event days. There are no events on certain days; some events require an additional admission charge. Days and hours of operation of concessions, venues and attractions vary based on event schedule. (the items listed between Clause 4.1.2 and 4.1.5 shall be referred to as the “Disney Package”)

4.2. In order for the Winner and any Guests to take up the Prize, the Winner and the Guests must comply with the following:

4.2.1. the Winner and the Guests must be able to get to either London Gatwick or Manchester Airport (whichever airport is deemed appropriate for the Winner) on 3 April 2020 at their own expense to leave on the flight on 3 April 2020 and must all be able to travel at the same time on the same flight;

4.2.2. the Winner and the Guests must be free between 3 April 2020 (when the flight departs the UK) and 9 April 2020 (when the flight returns to the UK) in order to take up the Prize;

4.2.3. hold all necessary passports, visas, health or other certificates to secure transit through any intermediate points and entry into the country of destination of the Flights and give all relevant advanced passenger information system (“APIS”) data to Virgin and, solely in the event that Virgin (or its directly appointed agents) has carried out a check-in of the Winner and the Guests within the relevant airport, Virgin shall check the validity of the Winner and the Guests passport and/or visa in order to avoid any fine from the UK Border Agency;

4.2.4. where any of the Guests are aged under 18 years old, they must be the child or legal ward of the Winner or one of the Guests who is over the age of 18. PLEASE NOTE: if any of the Guests are aged under 6 (six) years old then unfortunately they may not be able to be admitted into the audience for the recording of the final episode of the Programme – currently anticipated to be on Saturday 4 April 2020. This restriction may be subject to change at our discretion on a case by case basis but either way this will not prevent the Winner and their Guests (even if they include individuals under the age of 6 (6) years old) from taking up the Prize. Disney will offer an alternative viewing location to be confirmed on the Winner’s and the Guests arrival in resort;

4.2.5. the Winner and the Guests must all have a passport which is valid for the proposed duration of the Winner and the Guests stay (so between 3 April 2020 and 9 April 2020) (note: you don’t need any additional period of validity on your passport beyond this period) and the Winner and the Guests must be eligible and be able to obtain any required visa documentation for travel to the United States of America before flying and be able to comply with all applicable immigration and other travel regulations which the Winner and their Guests would be solely responsible for completing and incurring the costs for (if any). You will need a current ESTA for travel to the USA. If the Winner and the Guests have not applied for one before, they can do so online at the official website: https://esta.cbp.dhs.gov. We advise you not to use any other internet sites to apply for an ESTA as they will charge commission. An ESTA should cost $14. You will need a valid ESTA unless you have an I Visa. WE ADVISE THAT YOU START THIS PROCESS AS SOON AS POSSIBLE;

4.2.6. any children who make up the Guests must be accompanied by their parent or legal guardian; and

4.2.7. the Winner and the Guests will need to comply with further terms and conditions as provided by us, Virgin and Disney (which shall include but not be limited to what is set out in Clause 4.3 below).

4.3. The Prize shall be subject to the following conditions:

In respect of the Flight and Tickets:

4.3.1. standard baggage terms and conditions apply (which include complying with relevant baggage allowances). Virgin shall not be obliged to carry any baggage in excess of the allowances;

4.3.2. any liability of Virgin in respect of the Winner’s and Guests baggage shall not exceed Virgin’s direct liability under the Unification of Certain Rules relating to International Carriage by Air signed at Warsaw 12 October 1929 or that convention as amended by the Hague Protocol of 1955 of either or those instruments as amended by the Montreal Protocols of 1975 and Guadalajara Supplementary Convention of 1961 or the Montreal Convention of 1999 or the EC Regulation 2027/97 as amended by 889/2002 on Air Carrier Liability, as such instruments may be amended from time to time whichever may be applicable or other applicable law and shall be reduced by the amount of damages paid, or due to be paid, to the Winner and the Guests. For the avoidance of doubt, the Winner nor the Guests will be entitled to any compensation set by Regulation (EC) 261/04;

4.3.3. travel is permitted on the Flight only;

4.3.4. neither flying club mileage nor tier points will not be earned during the Flight;

4.3.5. transfers will not be provided.

4.3.6. the Tickets are not eligible for upgrade;

4.3.7. the Tickets are non-transferable and cannot be sold, bartered or substituted;

4.3.8. no cash alternative is available;

4.3.9. no further changes are permitted unless otherwise agreed. If a booking is cancelled no alternative tickets will be issued;

4.3.10. Virgin’s flight schedules are subject to change without notice

4.3.11. in the event that any of Virgin’s flight programme or operations are altered, suspended, cut-back or cancelled, Virgin is unable to guarantee that any affected flights will be honoured. In such situations, Virgin shall provide the Winner and the Guests with replacement tickets for a future flight;

4.3.12. any costs or expenses including without limitation, excess baggage, car parking charges, excursions, and attractions will be the sole responsibility of the Winner and the Guests;

4.3.13. save for any airport taxes, the Tickets neither include the cost nor arrangement of any applicable passenger visas, surcharges, taxes, and fees which will be charged to and payable by each passenger. Such charges are subject to change;

4.3.14. change fees may apply;

4.3.15. any misuse of the Tickets and/or Flight will entitle Virgin to withdraw the Tickets and/or Flights;

4.3.16. the Tickets and/or Flight does not include insurance (including but not limited to medical insurance and travel insurance). It is the Winner’s and his/her Guests responsibility to arrange whatever cover they need;

4.3.17. each passenger accepts the Tickets at his/her own risk. The Winner and the Guests agree to release Virgin from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the use of the Tickets (except death or personal injury caused by Virgin’s negligence, for fraud, or otherwise as prohibited by law); and

And in respect of the Disney Package:

4.3.19. the Disney Package can only be taken between 3 April 2020 and 8 April 2020 (plus one day for travelling back) (such dates inclusive) (the “Fulfilment Period”);

4.3.20. the Disney Package does not include the following items:

a. travel insurance;

b. UK ground transfers;

c. meals;

d. hotel room service;

e. laundry service;

f. alcoholic beverages;

g. merchandise, souvenirs, etc.;

h. local and long-distance telephone calls;

i. tips, gratuities, service charges or taxes; and

j. all other charges and items not otherwise set out within the description of the Disney Package;

4.3.21. further rules include, but are not limited to:

a. the Disney Package is for the Winner and up to 3 Guests of each Winner’s choosing;

b. Disney cannot be responsible for any unforeseen cancellations of flights or other arrangements;

c. the Winner of the Disney Package and all the Guests must travel at the same time on the same routing;

d. the Winner and the Guests must have (at the time of travel) a valid passport for at least six (6) months after arrival in the USA and all necessary visas or other required documentation to comply with applicable immigration or other travel regulations;

e. any children in the group must be accompanied by a parent or legal guardian.

f. the Disney Package may not be sold, traded, transferred, and rescheduled to dates not within the Fulfilment Period, or refunded;

g. the Disney Package and/or any holiday components of the Disney Package is/are not redeemable for cash; and

h. if the Winner elects to partake in any or all portions of the Disney Package with less than four (4) Guests, the Disney Package will be awarded to the Winner and any participating Guests and any remainder of the Disney Package which remains unallocated will be forfeited and shall not be subject to further or alternative compensation for the Winner;

i. Walt Disney World® Resort standard venue terms and conditions apply to access to the theme parks, waterpark and use of the tickets and passes, and Disney may require the Winner and their Guests to sign a release. If the Winner and/or the Guest(s) does/do not agree to these terms and conditions, they may be refused access to the parks or forfeit this element of the Prize;

j. the Disney Package excludes all other charges and items not otherwise described above; and

k. Disney, its parent, related, affiliated, and subsidiary companies and their respective officers, directors’, agents, employees and assigns shall be released and discharged from any and all legal claims, losses, injuries, demands, damages, actions, and/or causes of actions that arise out of and/or in any way related to the Disney Package, the receipt, use and/or enjoyment of the Disney Package.

4.4. Unless the Winner and the Guests otherwise have a valid visa to travel to the USA, we would expect the Winner and their Guests to be able to travel to the US under the Visa Waiver Program (“VWP”) and the Winner and the Guests should be aware that people generally qualify to enter the USA using a VWP if the Winner and their Guests:

4.4.1. have a British passport that (i) describes their nationality as a ‘British Citizen’ and (ii) is an ePassport with an internationally recognised symbol on the front cover; or the Winner and the Guests have a ePassport with an internationally recognised symbol on the front cover and are a citizen of another country which is recognised under the VWP; and

4.4.2. haven’t been arrested for certain crimes, even if a criminal conviction didn’t result (you should note that the US Embassy states in its guidance that: it does not recommend that travellers who have been arrested, even if the arrest did not result in a criminal conviction, have a criminal record, certain serious communicable illness, have been refused admission into, or have been deported from, the United States, or have previously overstayed under the terms of the VWP, attempt to travel visa free under the VWP);

4.4.3. aren’t a dual national of Eritrea, Iran, Kyrgyzstan, Libya, Myanmar, Nigeria, North Korea, Somalia, Sudan, Syria, Tanzania, Venezuela and Yemen

4.4.4. haven’t travelled to Eritrea, Iran, Kyrgyzstan, Libya, Myanmar, Nigeria, North Korea, Somalia, Sudan, Syria, Tanzania, Venezuela and Yemen on or after 1 March 2011; and

4.4.5. have received authorisation from the Electronic System for Travel Authorisation at least 72 hours before travelling.

4.5. it is the responsibility of the Winner to ensure that they and/or their Guest(s) adhere to the visa entry requirements to the United States and entry into the United States is ultimately subject to U.S government rules (which are subject to change at any time) and entry is therefore not guaranteed and we, Virgin and Disney cannot be held responsible for whether or not the Winner and/or any of the Guests is/are refused entry. Also, as of 31 January 2020, the US Health and Human Services Agency announced that the U.S. is restricting entry into the United States for foreign nationals (including UK nationals) who have visited China in the 14 days preceding any travel date to the United States. Therefore, please be aware that if, as a Winner, you and/or the Guests have travelled and/or are intending to travel to China in the 14 days preceding 3 April 2020 that this may impact your and/or any Guests ability to enter the United States. 4.6. It is also the responsibility of the Winner and the Guests to adhere to the local laws in the USA including but not limited to the legal age limit for buying, drinking and possessing alcoholic beverages which is 21 years or over

4.7. It is the responsibility of the Winner to inform Disney and Virgin of any wheelchair or similar access requirements for the Winner and/or their Guest(s) when taking up the Prize, and to adhere to any applicable health and safety guidelines issued by Disney or Virgin;

4.8. You agree and acknowledge that the Prize may be subject to change.

4.9. You agree that in no event shall you look to us in respect of any warranties or guarantees relating to the Prize or hold us in any way liable for the performance or suitability of the Prize.

4.10. In the event of any error and/or failure of any nature whatsoever affecting the manner in which the Feature and/or Programme is produced, the outcome of the Feature and/or the selection of the Winner of the Prize, our decision with respect to the handling of such error and/or failure including, but not limited to the selection of the Winner for the Prize shall be final.

4.11. Your refusal to accept the Prize shall constitute a forfeiture of the Prize and you shall release the Broadcaster and us of all obligations in connection with such Prize.

4.12. The Prize and any other token prizes awarded shall be non-transferable, non-negotiable, non-refundable with no cash alternative unless otherwise agreed with us.

5. YOUR OBLIGATIONS

5.1. When putting up a Poster at an Address please ensure you get the permission of the owner/main tenant of the property at the Address.

5.2. You agree to abide by the rules and regulations of the Feature and/or Programme as shall be notified to you in writing or verbally. You accept that we may vary such rules and regulations from time to time and that our decisions in this matter are final.

5.3. You warrant that you comply with each of the Eligibility Requirements and, if required by us, you agree to provide us with documentary evidence as well as providing all consents and assistance in carrying out any background searches if so required by us to substantiate the information provided in your Entry.

5.4. You agree, that if you are included in the Feature, to sign a further agreement at our request and you shall promptly execute and deliver such agreement and perform such acts and complete any other documentation as may be required for the purpose of giving full effect to the agreement.

5.5. You warrant that you will:

5.5.1. not (or attempt to) cheat, rig or otherwise falsely, unfairly or illegally influence or alter the outcome of the Feature;

5.5.2. not infringe the copyright or any other right of any third party;

5.5.3. not breach any contract or duty of confidence;

5.5.4. not constitute a contempt of court or expose us to any civil or criminal proceedings;

5.5.5. not bring us or any other party into disrepute; and

5.5.6. comply with all rules and regulations for the time being in force at such places where the Feature and/or Programme is shot or recorded.

5.6. You agree that we may in our sole discretion withdraw you from the Feature and/or disqualify you from any stage of the Feature and/or Programme itself and/or withhold or reclaim any prize (including the Prize) or other benefit awarded or due to be awarded to you as a result of your participation in the Feature and Programme if:

5.6.1. you engage in inappropriate behaviour (including, without limitation, being intoxicated, engaging in threatening behaviour and/or physical violence);

5.6.2. you supply or have supplied any untruthful, incomplete, inaccurate or misleading details and/or information or you have deceived us or the Broadcaster in any way including without limitation about your identity;

5.6.3. you fail to meet the Eligibility Requirements;

5.6.4. you fail to abide by these Terms and Conditions or the rules and regulations of the Feature and Programme;

5.6.5. you fail to abide with any of our other reasonable instructions or directions; and/or

5.6.6. by reason of your conduct (including past conduct) you bring us or the Broadcaster into disrepute.

6. INTELLECTUAL PROPERTY RIGHTS

6.1. To the extent you are a Winner, you agree and consent to (i) you and your property at the Address being filmed and recorded in connection with our attendance at the property at the Address for the Feature and Programme and (ii) being filmed taking up the Prize (including on the plane and at the Walt Disney World® Resort) (the “Contribution”) and the use of your Contribution in connection with the Feature and Programme in whole or in part or not at all.

6.2. You irrevocably grant and assign to us by way of present assignment of present and future copyright, all rights of any nature in and to the rights, title and interest in your Contribution so as to permit the fullest use throughout the world of the Contribution or any part(s) thereof by all means and in all media in connection with the Feature and/or Programme or otherwise in perpetuity. For purposes of clarity, you accept that we have the right to edit, copy, adapt or translate the Contribution as we see fit.

6.3. You grant us the right to use your name, voice, likeness, photographs and any biographical material and any Contribution concerning you in connection with the promotion and exploitation of the Feature and/or Programme and/or ancillary products/services and/or in connection with us and/or the Broadcaster, throughout the world in all media in perpetuity.

6.4. You irrevocably waive the benefits of and agree not to assert any provision of law known as "moral rights" or any similar laws of any jurisdiction in respect of any Contribution.

7. LIMITATION OF LIABILITIES

We shall not be under any liability in respect of:

7.1. any expense or costs you incur by obtaining a Poster; or

7.2. any claim for loss of publicity or opportunity to enhance your reputation notwithstanding the fact that we may delay or abandon production or exploitation of the Feature and/or Programme or the use of the Contribution (notwithstanding that we may have advertised the same) or terminate this Agreement; or

7.3. any loss or damage to your property whilst in transit to or from or whilst at places where you shall render the Contribution under this Agreement except to such extent if at all as we may be able to enforce a claim under any policy or insurance effected by us; or

7.4. any personal injury, ailment or your death arising out of or in the course of the engagement herein to the extent permitted by law and except to such extent if at all as the same was due to our negligence.

8. CONFIDENTIALITY

You shall keep confidential and shall not disclose to any third party any confidential information, photographs or other material relating to us, the Feature or the Programme or anyone taking part in it, which comes to your knowledge as result of your participation in the Programme and Feature (if any). The foregoing will not include matters already in the public domain (other than by way of your breach of this Clause).

Should you be a Winner, you will be invited to provide, and may do so at your option, your diversity characteristics – gender, ethnicity, disability, age, gender identity and sexual orientation.The broadcaster, as data controller, is responsible for this data and will have access to reports compiled from it for purposes of the research.Further information can be found here:

10.2. Should there be a dispute regarding your participation in the Feature or Programme our decision on this dispute shall be final.

10.3. You agree that we may freely assign or licence your Entry (including these Terms and Conditions).

10.4. Your Entry and any non-contractual obligations arising out of or in connection with it or its subject matter, shall be governed by, and construed in accordance with, the law of England and Wales and each party irrevocably submits to the exclusive jurisdiction of the courts of England and Wales to settle any dispute or claim that arises out of or in connection with the Entry or its subject matter.
