'an application has now been made to enter a county court judgement against you'
You could ask and expert...Why not put in a complaint to the SRA that DrydensFairfax has sent a LiP (Litigant in Person) misleading information about your legal rights.

While linguistically correct, it is how LiP would view it. Suspect it is their standard response to a SAR as they are very, very useful for you.

When you get the paperwork from the court, come back and we'll see what you need to do. Get the paperwork.
    • All land is owned. If you are not on yours, you are on someone else's
    • When on someone else's be it a road, a pavement, a right of way or a property there are rules. Don't assume there are none.
    • "Free parking" doesn't mean free of rules. Check the rules and if you don't like them, go elsewhere
    • All land is owned. If you are not on yours, you are on someone else's and their rules apply.

  • Hi,
They obviously believe your defense will not stand up in court, and are proceeding to ask the court to grant judgement in their favor.

What was your defense out of curiosity ?

The court will consider their claim, and your defense, and act accordingly.
Arrow/Dryden`s do this on an industrial scale, they gamble on you either not defending or your defense collapsing, or you just not bothering to defend, then they win by default.
I just wrote one based on templates and examples I found on here and other websites. Basically, I denied their claims (I'm not 100% sure what this debt is for), also wrote that they have not provided documents I have requested, that their particulars of claim is very vague, that agreement is unenforceable because of non-compliance with an information request under section 77, 78 or 79 of the CCA, etc.
I get that they lie, but I'd never thought they pull info out of thin air. To me this is completely unethical.

    I'll look into it, thanks.
