HELP! 5% deposit incentive on a mortgage, Do I have to pay the builder back?

I agree with the letter New Shadow drafted. It is clear and to the point.How dare the builder offer you an incentive gift and then demand it back ! He is obviously short of money and desperate.0

I have spoken to my solicitor who helped with the sale the house and they told me he is committing mortgage fraud and they would of never sold us the house if they knew he was offering the gift as a loan. I now have this in writing so I am just going to let it run it's course and if it does go to court at least I have two forms of evidence I just hope this will be enough.
