Afternoon All,
I've had a good search around the forum, & not getting far but could someone explain in simple terms about about inside / outside IR35 please, as I am hearing conflicting information on this subject: and it is all opinion, rather than perhaps an authority on the subject.
Just a brief bit of back ground, I hold fairly senior management roles, and umbrella'd for 3 months a year ago before going perm, but due to company circumstances, I am back in the market - and seeing roles advising both inside or outside IR35.
I have made a few enquiries locally, and some say go 'outside' only, while others say that isn't so easy.
- All opinion however, are advising there is an impact to contracting now though come April, so I want to ensure I am not walking into a problem.
- apologies if this is basics, but I've had no exposure to this subject previously.
thanks for your time

IR35 itself doesn’t change however, in the private sector, the client will make the IR35 determination from 6 April onwards. The impact of this is wide ranging. Primarily, a lot of large clients have taken a blanket approach in order to avoid falling foul of HMRC. Therefore, most contractors in large organisations are being asked to move from outside to inside. The issue with this is that HMRC are likely to investigate contractors that are already on assignment but change from outside to inside because they believe the client determination should have applied all along.
How does this translate to you? Well, Firstly, you don’t get to chose if you are inside or outside. Even though you are pre rule change, any contract will take you over, so you will almost certainly be inside. If that is not suitable, and given the market is flooded with long term established contractors looking for outside roles, I would suggest stick it out in the perm market until it all settles and you can see what direction contracting has taken.0 -
Hi
I would suggest that you go and look at somewhere like https://www.contractoruk.com/forums/.
When looking at ads, you will see for contract roles the ad will either say inside IR35 or outside IR35. Inside IR35 is either going to be PAYE or Umbrella - most of the roles I am seeing are inside IR35.
