PCN CC Claim from gladstones and UKPCM

Morning, wondering if I can get some advice. Cc claim received 13th Jan, I've just found this site and a defence outlined by bargepole that I have adapted slightly (hope this is ok) we did not receive an original PCN just debt letter and gladstones demands. We informed Trace never received original PCN which from reading on here was probably wrong decision they simply stated as they sent it we must have received it. So that is done so moving forward they are claiming from on the form the defendant as the driver/keeper of the vehicle. So driver not identified. We have figured out where the car was parked from their sparse information of simply a road name. So before I post defence as we now know where vehicle was parked it would seriously implicate who driver was. Is this OK as it's already at CC claim stage. Also we can not be sure 100% who actually moved the vehicle. So just wondering if I can post the particulars on here as to how the vehicle was parked and poss reason if we have not informed them of driver? Thanks in advance for any response

  • Sorry just to say I have acknowledged claim and requested via email SAR from UKCPM and gladstones. UKCPM are being difficult in making me request via a form to which the link does not appear to work and gladstones have as stated refused. So have re sent using a template from here to UKCPM via email again. I understand they have 30 days but I have only until I think 15th Feb to enter defence. I have not found this information until now

    What is their breakdown please
  • Hi beamerguy, so £100 for pcn £60 for costs pursuant to the contract, plus statutory interest of £10.81 SO WITH COURT FEE AND LEGAL REP COSTS TOTAL IS CURRENTLY £245.81

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Of course they did, WHAT CONTRACT ???? Do the signs in the car park very clearly say they will add £60 ?
    Did the ticket state that a fake £60 would be added ??

    Gladstones have already been kicked out of court for this fake

    GLADSTONES: .... The rep sent by Gladstones admitted to the judge that the fake add-ons WERE FALSE This is now what any case can turn on if the FALSE add-ons are applied

    Inform them as per ICO guidelines:-


    "Should we provide a specially designed form for individuals to make a subject access request?


    ......However, even if you have a form, you should note that a subject access request is valid if it is submitted by any means, so you will still need to comply with any requests you receive in a letter, a standard email or verbally.

    Therefore, although you may invite individuals to use a form, you must make it clear that it is not compulsory and do not try to use this as a way of extending the one month time limit for responding."
  • No it says it will be reduced to £60 if paid in 14days. The signs are also in pretty poor state of repair. Will read above links

    You say that you received a County Court Claim Form on 13th January, but what is the Issue Date on that Claim Form?

    On what date did you file an Acknowledgment of Service?
