Letter from Insolvency Examiner.

Options
Hello,

In 2018 I bought a car off someone as I needed something for work. Now last week I have received a letter from a Insolvency Examiner saying they know I bought the car asking for the following:

1) make, model, registration.
2) how much I paid and proof.
3) proof I have ownership of the vehicle.

I have no problem answering the first one but I paid cash as it was only a small amount (sub £1000) and have no proof, and as I no longer own the car I have no proof of ownership.

Do I even have to reply to the letter as the Insolvency case has nothing to do with me? Really not sure what to do.

Whats the reason why this has been sent to you, are you an undischarged bankrupt ?

It does benefit you to fill in all the gaps, instead of having to drip feed information from you, so the more info you can provide, the easier it will be to respond to you.

  • According to the letter I've received a bankruptcy order was made against the person I bought the car from and they are investigating their affairs.

I'm not a undischarged bankrupt or ever been bankrupt.

    Ah, right, i understand now.

As you are neither bankrupt, nor a former bankrupt, you are under no obligation to cooperate with the OR in this matter, however, you can just fill in the information you are comfortable with providing, and leave blank the bits you don`t want to fill in, for example if you paid cash, just say so, also say you have no proof of this, its a fairly common way to buy a car after all.

To my knowledge the OR has no remedy against you should you fail to cooperate.

Sounds like they're trying to work out if he sold it for a market price and whether what you say you gave him matches what he says he received for it.

I have had a case where a third party who was gifted a car by the bankrupt was sent an invoice by the OR for the value of it.
