Am i bankrupt?

This may seem like a silly question - but i've just had a conversation with my bank about something totally unrelated, and they said its showing i'm bankrupt on my file.

I'm not aware of this, have never received any letters about it. I've been at this address for 4 1/2 years and am registered here.

Is there anywhere I can find out if and when i became bankrupt??

Did they say what they meant by "their file"?

Do they mean their own internal records? Or have they picked up the info from Credit Reference Files, Gazette etc?

If a bankruptcy has been recorded against you it should show up in a search here (where all are published):

    http://www.gazettes-online.co.uk/

If you were currently bankrupt it should also show on the Insolvency Register here:

    http://www.insolvency.gov.uk/eiir/

If your records are all in order it should also show up in the "Public Record Information" on the CRF's.

    Thanks for the info.

They were trying to upgrade my account, from the basic one i had to set up when i went into an IVA 2 years ago.

Could it be the IVA that is showing me as bankrupt on the credit report?

An IVA would show up on the credit reports as a form of insolvency.

Are you still in the IVA now?

its in the process of failing. I sent them my new soa in April, and they said that as i only had £95 a month left (it was set up at £280), the creditors wouldn't accept it.

I told them that i'd have to declare myself bankrupt, and am currently in the process of trying to scrape the cash together to do it. Its not going to happen before christmas.

It just occured to me that someone might have filed for my bankruptcy - which is why my bank said it was mentioned on my file.

On the insolvency register, i'm on as IVA.

In that case I would get onto your IP/supervisor to find out was has been happening.

You really should have been notified if the IP/company had made you BR or a creditor had done it, but some bizarre things sometimes do happen.

The other alternative I can think of is that perhaps your IVA has now been marked as "failed" on the CRF's? 3 months of inadequate payments seems to be a common time-scale from what people say. Lot's of bank staff are pretty clueless at interpreting these things and get them mixed up.

Whatever happens, your Credit Files have already suffered because of the original IVA and it's always possible you would have been refused the upgrade anyway.
