Howard Cohen Court Order Letter - 2008 CCJ

Hi all,

I have a CCJ from 2008 originally from Intelligent Finance for £4k.
This should have been set aside as statute barred at the time, but was granted to an old address without my knowledge, and I have since just let sleeping dogs lie (rightly or wrongly).

I have just been sent this letter from Howard Cohen stating that they are now the claimant, and there is a copy of a court order from July 2019 (again I knew nothing about this until now). They say to continue to deal with Robinson Way, although I have never spoken to them at all.

I do know that a CCJ that has been left for 6 years or more would need court permission to enforce, so do I reply to these letters at all, or wait it out? The court order states 'Multiple' Defendants - is this a bulk court order to cover all of their applicable clients perhaps?

Sorry as a 'new user' the site won't let me link or post the actual letter and court order - is there a way around this?

The covering letter reads as follows from Howard Cohen & Co Solicitors:

'We write further to the correspondance you received from Hoist Finance UK Holdings 2 Limited (HFUKH2L) confirming they are now the legal owners of the above referenced account.
Our client has instructed us to send this letter for information purposes.
Our client instructed Blake Morgan Solicitors to submit an Application to the Court to substitute the Claimant details from HPH to HFUKH2L. This Order has now been granted by the Court. Accordingly please find enclosed the Court Order confirming the position.
We request that you continue to deal with our clients agent Robinson Way Limited in respect of this account. If you are not already in contact with them, you can contact them on 0330 678 0979 to discuss the options available to you.'

    It's called a Global Substitution Order, I think, and there are other threads so there's a lot of it going on.

    They're not demanding money nor threatening to enforce the ccj, so you do not need to do anything.
  • Thanks for that you are dead right, when I've looked at the letter further, the court order states 'GSO Application' Claimant being 'Hoist Finanace UK Holdings 2 Limited' and 'Multiple' Defendants.

    I will indeed, not do anything further for the time being.

    Does anyone know what their next step might be?

    t829usx and onwardsandupwards127 received this letter too during the week and have posted regarding this. ccj became 6 years old on 16th January, I am waiting to see what happens next. ccj was never paid as it was not my debt. i am also interested in what the next step might be but will be waiting for their next move.

    I got the same letter, stamped July 2019. They spelled "multiple" incorrectly on the photocopied? "court" page that was sent.

    No idea if this is legitimate or what to be honest.
    Mine is with regards to a HSBC credit card and apparently they got a CCJ against me for it last year. Never knowingly had a HSBC card as been banking with Lloyds since the 1990s, and I've not made any payments onto a HSBC card either (although I suspect that there would have been some "random cash" payment made during the last 6 years that prevented this becoming statute barred).

    Can they even get a CCJ against something that should be statute barred?

    Need to check my credit record, but the Credit Club / Experian won't accept my name, address, DOB etc.

    (Also got a letter from Robinson Way dated the 28th Jan, with the letter saying Hoist were taking over being dated the 23rd. Offered me a full & final settlement offer of £3188 instead of £6087.80, the default being marked as "partially satisfied" and the CCJ as "satisfied" if paid. Also the option of monthly payments)

    Mistakes do happen, anyone can get a CCJ on any debt, anytime, if its not defended, your defense would have been the limitations act 1980, but apparently you didn't receive the court documents, so have you moved, or is this really a case of mistaken identity ?

    I've never been with HSBC.
    Barclays back when I left school and worked at McDonalds before college, but that was back in the late 80s. Then went to Lloyds and been with them since.
    Bradford & Bingley (now Santander) savings account but stopped using that after someone took my passbook and cleared my account.

    Had a quick look at Experian just now (not clear at all website wise) and there does seem to be a CCJ there for this (no real indepth details though).
