Creation
Hi,
Need some help and not sure what my next steps should be.
My dad sadly passed away earlier this month and I'm in the process of closing down his financial affairs. I've identified a payment going to Creation Finance and have contacted them by email (no response) and telephone. They asked me to post off a death certificate which I have and am since awaiting a reply.
The concern is despite my dad having paperwork for everything he owned he has nothing relating to a loan with Creation. Since he was 72 years old at the time of the first direct debit, retired on a state income and with no assets or estate so doesn't even appear to eligible for credit with that company.
Is it possible someone took finance out in their own personal or company name using his account for payment? It is something he may of agreed to so I'm not implying or searching for any dishonesty.
Likewise if that was the case I'm assuming that with GDPR rules Creation would be unable to discuss any details with me as my dads name may not be on the agreement at all, just his bank account number and sort code (now closed) and any chasing of non payment would go to the named credit holder.
Please someone give me a direction to go in. All his other affairs are being resolved but this is lingering around with no progress.
Thanks

Creation do store finance for DFS , Currys pcworld , sofaworks etc.

Thanks Browntoa,
I've explored that as much as I can. My dad had receipts for everything so if he'd purchased anything from retail stores I'm sure I would have found paperwork.
The other thing is the size of the payment £83 every month so whatever he was paying off must of been fairly expensive. That also doesn't explain how he can have a Creation loan if the correct details were given. He was simply too old and not enough income to qualify.
If Creation don't respond I may have to consider escalation.0 -
Maybe a subject access request would work.0

Thanks DCFC79,
That sounds like a good idea however can I do it for a deceased relative? Think I may make the request anyway, can't hurt I suppose.0 -
There's not another family member who could have got your dad to sign the paperwork "and they will pay him back " or had access to his financial details ?
Most fraud is by someone they have contact with , friends , family , carers etcEx forum ambassador

Think it’s far too soon to be exploring the ‘fraud’ route, as already advised creation provided credit for a number of different providers - age unlikely to be a barrier in such credit purposes and £83 a month isn’t a great deal and could easily cover an white goods appliance or furniture purchase.
As creation will need to satisfy themselves that they have the relevant authority to deal with you, you will simply have to supply any documentation they request.0 -

He would be the named debtor, as the payments were coming from his account, the names/details must match, also the credit would be in his name.
Creation will respond to you, they just need to update there records first, with large organisations, this can take some time.
I`m assuming you are the executor of his estate, or you have power of attorney to act for him, or the court of protection has made you responsible for his affairs, as long as you are legally entitled to act on his behalf, then creation should divulge the nature of the business your father had with them, you can then sort the matter out to your satisfaction.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Thank you Sourcrates,
Yes I am legally responsible to handle his affairs and so far all companies both financial and service based have been very fair and transparent.
Creation is the only one I have no details or paperwork for but I’ll be patient and allow then to process at their speed and if there’s an agreement I’m sure they’ll make me aware.0 -

Yes a SAR should work (They should send everything they have access to, I cant see them not sending everything meaning you take this option), see what Creation come up first and if they dont come up with anything then come back for advice on your next step.0 -
You can't do a SAR for a deceased person.0
