  • I’ve read both threads and I have to say I’m struggling to understand exactly what the lender did during your extension that prevented you from doing up and selling the house. With no plan in place to ever pay off the balance you always knew this day was coming. Depression is awful, but unfortunately it is not the banks problem. They were kind enough to grant an extension to you in order for you to sell up. This was never a solution as they still needed the money, all you could have done was bitten the bullet, waved a paintbrush around and sold it. I’m not seeing why you couldn’t do that.

    Regardless of any minor technicalities at this point, the fact remains you did not pay off your mortgage as agreed. Everyone has family crisis’, everyone has bad periods, but we all know that a bank is not going to just ignore a large debt because of that. It’s the way of the world.

    I honestly think you need to just move on. Take the money and complain. Don’t waste yet more years obsessing over this and getting more depressed,costing yourself more money at every step. You’re already facing a new eviction, what will it take to get you to stop? You can’t turn back the clock and have the house back regardless of who was in the wrong when, so just make a better future for yourself.

    Taking the lender to court will incur more costs so I would lean towards taking the 50% of the surplus as stated by the lender. Have they told you any figures.
