Informing Landlord

Hi can anyone tell me if my landlord will be informed even if I have never missed a rent payment?

  • my landlord has not been informed as far as I know.
    Bankruptcy order has been issued 2017 11.
    I have never ever missed rent payments.

    They won’t be informed, however if anything changes for whatever reason and you look at renting a different property, any letting agency might carry out credit checks ect, so it could be an issue then.

    The only reason I can think of for talking to a landlord is if you’re unable to provide a copy of the tenancy agreement and your statements don’t evidence you paying the same amount every month. Under those circs the OR may want to contact the landlord to confirm the amount of rent you are paying them.
  • I recently moved out of my apartment after 2years of dedicated rent paying.According to the agreement i would give a month notice.I gave about 18days notice and moved out the 3rd of Dec 2019 as i was starting a new position and my new employer wanted a quick start.I requested for my deposit but my Landlord is beginning to prove difficult and claiming that mt agreement stated 30days notice. He never provided me with evidence of the deposit scheme all along.

    I was advised to be honest with my landlord when it came to my bankruptcy. I spoke to the letting agent first who then said that there’s nothing in the clause to state that bankruptcy is an issue. I then asked them to tell our landlord who said that we pay our rent and he has no problem so long as we still pay rent.

    Got our deposit back no problem when we moved (kind of. There was a small dispute with the TDS but that was another issue)

    Went bankrupt in June 2019 and our landlord was informed of it. You have to put your current address on the forms and also landlord details if you are renting so I would expect them contact your landlord. That was my experience anyway. Fortunately our landlord is a friend of ours so it wasn't a problem.

    I would not worry about it. As you say you have always made you rent payments, and after bankruptcy, you are even more likely to pay him.

    So unless he's a complete fool, he wont bat an eyelid as as when he is notified of your bankruptcy.

    My landlord was not informed, we have never missed a payment and we've been in the same place for over ten years.

    I asked a similar question at the time and I think I was told that providing there is no clause in your contract about not being bankrupt then it's not a problem and you don't need to inform your landlord. I also asked during my telephone interview with the official receiver's office, she said they are not contacted unless obviously rent arrears are included in your bankruptcy, which is fair enough and fairly obvious.

    Amusingly in my case, a 'sh** stirrer' actually informed my landlord! Without actually raising the subject with me as he probably didnt want to embarress me, he made it quite clear he will continue to renew our lease for as long as we wish to be here.
  • Well, my landlord was informed of my bankruptcy, which I was not happy about. There were no rent arrears, council tax debts, utility debts or any financial issues related to the house. I'd also provided all of the requested paperwork (tenancy agreement). I don't know what the OR told the LL or why, but my landlord was definitely told.

    So I would advise asking that the LL is not informed if there is no debt related to living at the property.
