CCJ written off after 6 years?

Hi, what is the process after 6 years? My other half has a CCJ which will be 6 years end of Jan, does this automatically come off his credit file or does he have to do anything?

  • A CCJ is not written off after six years. It will be removed from your credit file though after six years from the date of the judgement...but the CCJ would still be valid...

    CCJ`s never become statute barred, and are never written off, they remain in effect " in perpertuity" forever, or until settled.
    They do fall off your file after 6 years automatically, but remain enforcable in law.

    However, 6 years is usually deemed sufficiant, for the creditor to enforce their rights under that judgement, unless you were living on the moon, or the other side of the world, you should normally be tracable.

    So in order to enforce a judgement over 6 years old, they must go back to court and seek its permission to do so, they must satisfy the above criteria, that they have tried to locate the debtor but failed to do so, if the debtor was living in plain sight, the application would be refused, if, on the other hand they had attempted to evade the judgement by going "off grid" the court may grant its permission to enforce, its done on a case by case basis, but normally 6 years is deemed long enough for enforcement, most debt purchasors know this and won`t take the matter any further.

  • I got a CCJ from NatWest in 2008 and therefore dropped off my credit files in 2014. It was never paid so this means it still exists. It is now 2020 and I've not heard anything about it in at least 10 years. I doubt anything will ever come of it now.
