boss wont pay holiday after leaving or give p45

    So I left my PT job 17th December, after giving a notice period of 3 months. Boss said he didn't want me to use up my holiday days as he would rather I worked. Now he is saying 4 of those have been used up over Christmas which is after the point i left. First question, theres no way he can claim that right? Wrong, if your official leaving date is later than the date on which you last physically worked.?

    If my final day was the 17th, which is the day i gave my notice for that is surely the official leaving date? I only ask because my payslip says i have 12.5 days holiday and he says i have used 4 of those for Christmas so he says he will not pay for them.

    On another note is there anyway I can find out how many days i have actually used up? not a calculator - i mean what he and HMRC officially see?

    As an update - I got my p45 and now will get paid 2 days holiday at the end of January

    What date does your P45 show as the day your employment ended?

    Does the amount you have been paid for work take you up to include the Christmas holiday?

    HMRC don't get told about your holidays. All they care about is how much money has been paid to you and that NI has been properly paid.
