Stamp Duty on Buy to Let

A couple of years ago I bought a flat to rent out and paid the excess Stamp Duty. However, I moved in to redecorate the place and Ive stayed. This is now my permanent residence. Can I reclaim the Stamp Duty?

    Not necessarily. A SDLT surcharge refund only takes place if you sell your previous main residence within three years of purchasing the second property.

    If when you bought the flat it was your only property, then perhaps you should not have paid the extra 3% in the first place. You do not say what else you owned at the time.
