Separating mortgage advice needed

Sorry was unsure what section to post under ...
So have been separated for 6 months and my ex has refused to pay mortgage and other family related finances from separation until house is sold also not signing a mintue of agreement stating she should be responsible for paying her half of finances from the sale of the house . I have since been living with parents to let the children live in the house until house is sold she is coming out with around £200 more than my self per month with her benefits / wages and child maintenance paid by me now the question is if I was to peruse this in court what would be the likley outcome ... currently around 3.5k owed to me of unpaid finances from her & would letting the house fall behind in payments be another option of forcing the sale of the house??

    So is the house on the market ?
    Is your EX allowing viewing and keeping the property in nice tidy condition and prepared for sale ?
    Where will your EX and the kids live once the home is sold.
    Can she get a mortgage on her income ?
    House prices, age, job/s ( if both of you are working )
    Equity in the property, savings, pensions, solicitors and one hundred other things can effect the outcome you may or may not want.
    We know very little about you !!!!
    I know this is a forum about mortgages but separating with young children involved can be a long and difficult process.
    Having been there and done that I can only add stay positive for yourself and the kids.

    House not on the market as she will not sign the minute of agreement which says 50/50 apart from she must repay her half of bills until house is sold currently around 3.5k .
    We are both currently have around the same income at the moment .
    Would be most likely she would not get another mortgage on her income but not been discussed social housing I would guess .
    Bought the house for 180k & it's down to 150k with current equity . No savings & she has her own pension to keep . She works part time retail gets child maintenance & around £950 per month universal credits both in our 30s with 3 children involved ranging from 4 to 9 . I am paying solicitors & she receives legal aid . .Hope this helps and thank you so much for your opinion especially since you have experienced similar .
    ( No overnight contact with children for me until I get my own place and cannot get my own place whilst paying all finances combined with solicitors )

    So £150K mortgage which is taking a huge amount of your income plus other bills.
    I had to rent for 3.5 years before I was able to move on.
    The courts will not force through a sale of the Family Home your 3 children live in so making them homeless !
    Unless you rent a 3 bed house NO overnight contact with the kids
    CAB or back to solicitor.
    If you stop paying the mortgage the lender will take action to evict your EX and the kids and your credit score will be destroyed for some time.

    Thanks - just seems criminal that moving out a house which she claims she cannot make half payment on isn't an option but me paying it from a bedroom in my parents is ? Look forward to what solicitors say once they return after the holidays .

    Why can’t you have children overnight - is it because there is no room At your parents ? You could always take them to a travelodge or similar for a cheap weekend.
    Mama read so much about the dangers of drinking alcohol and eating chocolate that she immediately gave up reading.

    Yeah I'm in just a box bedroom myself no space ... lucky for her to stick to the days agreed with mediation & house was supposed to be sold before Halloween & still no further forward today but nice suggestion.
