Hi all can you please help me, i don’t want to go bankrupt but creditors are getting out of hand and i felt like topping myself to ending my life, Howell Solicitiors state they have obtained a CCJ against me, even thou Ive not had anything from the county court, i thought the court would of least send me a letter of CCJ order.
Anyway going forward I want to make offers on my debits to clear some of them off, if I can avoid bankruptcy order, so i come up with this letter below to be sent to howells what do you think? sorry i’m not very good at my grammar, not very good at writing letters and would ask what you think?
Dear Sir/Madam
I write too you in regards to these debit(s), I have now seriously considered going bankrupt as a result of over £85,000 worth of debit.
I will attempt to make you an offer for both debits, you currently have for me, should you fail to accept my offer, I will add you to my future bankruptcy claim, which will be filed in due course, however to help show the court before filing for a bankruptcy order I am trying to settle some accounts as gesture of goodwill and responsibility.
I’m offering you a one off final opportunity for you to accept 75% to be written off both debits and it to be satisfied as settled. (25% combined of both debits)
Should you not accept my offer, that will be fine , I shall forward and declare bankruptcy and add you to the long list of creditors, you should be aware there are other creditors that have more priority in larger debits in my bankruptcy claim that is pending subject to my creditors replying to my last offer to settle some debits before my bankruptcy.
Making a claim for bankruptcy, my debit councillors said the chances of you getting as much 0.5% is very unlikely under bankruptcy order, I am offering you the chance to combine both debits 25% for both debits. This will be subject however to conditions that debits are settle in full and final.
I understand you bought my debit and i’m making this one time only offer, I am only doing this to show the court that I have engaged with my creditors and made an offer to write off 75% of my debit and pay 25% of it as full and final settlement.
Should you not wish to accept my offer, please place it in writing and one will be happy to attach your reply to insolvency official. I am in no mood too play games with my creditors you either accept or don’t.
Pro’s of accepting my offer will result in you not being added to my bankruptcy claim and getting a generous offer of 25% of the debit being paid to you.
Con’s not accepting my offer will result in you receiving less than 0.5% of the whole debit owed under the bankruptcy order, as you are a very small amount owed compared to others, it will most likely that you do not get anything at all.
I look forward to your reply.

Hi
I'm sorry that you have not had any quick responses to your post. You put it in a relatively quiet bit of the forum. So let me make some general suggestions:
1. I'll ask the mods to move this to dfw.
2. If you are having suicidal thoughts you should seek help for this alongside debt advice, and your GP is your first port of call here. Non-priority debts are not that important in the grand scheme of things, there are half a dozen major strategies to deal with them, and you are clearly aware of two of those.
3. To help you determine which strategy will work best for you we will need more information. If you can complete a statement of affairs, format for mse, remove any links and then cut and paste it, that will help us

4. If full & final settlement turns out to be the best way forward we will help you to polish that letter. Do you genuinely have 20-25k in cash with which to make that offer?
5. It would be worth seeing what each credit reference agency is recording against you. If there is a ccj that should show.
There are three main ones and they all have free services:
Equifax - clearscore
Experian - mse credit club
TransUnion - credit karma0 -

I would certainly look for help from your doctor as a first step. Next would be to change the letter - especially the tone. I know you said that you are not good at letter writing but it may sound better if it was not like a threat.
