Missing Debt

Options
Hello,

Thanks in advance for reading this post.

I had an old £7K debt I was paying off from my student days. It is a Barclays consolidation loan from circa 2000. However, it has strangely gone missing from my credit report, I no longer receive any letters about it and the direct debit I had doesn't seem to exist anymore. The last letter I have is 2 years old! I went back to the debt collection agency who handled this matter and they said they were no longer handling the account. I have not changed address. I have asked Stepchange but they couldn't shed any light on this matter, I have also asked Experian and the feedback was the same. Before I approach Barclays about this, I would like to know if anyone else had any similar experiences and if this odd experience of mine might have anything to do with the recent "Barclays refunds saga." I'm not passionate about a refund but I would like to know if this debt still needs to be paid off! The experiences of others would help me gauge what I might expect when I get in touch with Barclays. Knowing my luck it's some computer error and I'll get slapped on the wrist for something. :(

  • I just lifted the following from a DebtCamel article:
Unsecured debts, including most loans, credit cards, catalogues and overdrafts will normally be statute-barred in England and Wales if you can say YES to all the following four points:
    • it had been more than six years since you last made a payment; and
    • the creditor has a cause of action more than six years ago; and
    • you haven’t acknowledged the debt in writing during this time; and
    • the creditor hasn’t already gone to court for a CCJ.

The cause of action would be the date of default.

Do you think that your missing account may be Statute Barred?

It's probably more than 6 years since it defaulted.

If they want paying, they'll write.

You can then have a look at whether this is a valid debt. Until then, leave it alone
  • Thank you for your informed reply! I will have to investigate if this is the case, though I'm sure I was still making payments. I will check my past statements. Thanks again.
  • Thanks for your reply, you've given me a direction to do some further research. I'll get on it! Thanks again!
