Employer miscalculated holidays but encouraged us to use them before realising

    Did they write or email you their calculations with the excess days?
    If so it would be proof they had led you astray & would be good form for them to take the hit.

    I believe what probably happened was when they upgraded my contract, theyv'e messed up and not accounted for my old contract and just added both holiday amounts together on top of each other :/ or the system has given me my whole years holiday at the start of the year and then as I've worked it's given me double instead of earning the holiday back, if that makes sense ahaha I'm bad at explaining

    I would happily work a few extra days without pay, only the reason I'm dropping is because my university course is starting and takes up 4 days a week aha, and January is usually slow with no room for extra shifts :(

    If you post details of your hours/days worked for the holiday year and the full timers allowance it will be possible to work out what holiday you accrue.

    Are your contractual fixed hours/days or variable?
    8hrs to 24hrs in May, and yet from January until the start of October I was working an extra 8-16 hours overtime every week

    add holiday year with the date the contractual hours changed.

    Then total hours before and after the contractual change.

    Can work out some numbers from that.

    edit can you add how much they said you had and how much they say you have now.

    Hi sorry, been at work!
    Had a chat with the owner and she talked me through everything and exactly how the system went wrong - it's a new system this year, and as it turns out the people who provide it told her the wrong way to set holidays up for hourly workers compared to salaried workers and so we accidentally earned like double the hours we were supposed to have!
    She was very transparent about it all and I could tell she was having a bit of a breakdown so Im content with whats happened, we're working it out so I don't have to have any wages deducted or pay anything. :)
