    Hi,

    You have the option of making a money claim against this individual, anytime you want, regardless of anything else that may be going on just now.

    The key is to have as much proof as possible that the debt is owed.

    However the solicitor does raise an important point, not many people can put there hands on 30k, just like that, he may have to sell assets in order to pay, that’s if they choose to pay, even if you obtain judgement against them, it’s no guarantee you will get any money.

    Getting the judgement is just the start, you cannot force sale of the house, not realistically, if they don’t want to pay, getting anything from them will be extremely hard.
