Is this a CCA?

Hi all,

Hoping someone can advise if this s in fact a CCA? I'm advised by the DCA that it is but it doesn't appear to meet requirements, having never seen a proper CCA I wouldn't know one to see one. The card in question is from 2016.

Page 2 redaction is my name and address at the time, below that it mentions U Switch was the source of application - I never had a uswitch account until 2019 and that was only for a utility switch.

Page 14 the statement of account is a statement from Cabot detailing some initial payments to them not anything from Virgin Money.

Can anyone please advise? I assumed this wasn't so have not contacted Cabot. Prior to receiving this "CCA" in July I had offered a 5% F+F and this was rejected. I haven't made any contact since.

They have recently got more aggressive in the last few weeks and today I received a letter suggesting they will look to recover the amount by other means which may include doorstep agents coming to my home to discuss my situation if I do not reply within 9 days.

This does worry me slightly as I have bad anxiety and a young family at home, whilst I know these agents have zero power, my family do not need to be subjected to it and frankly I already have my share of sleepless nights with a baby! Links;

    Looks ok to me, there is a great misconception about what exactly a creditor must provide under a section 77/79 request.

    As long as the main financial information is there, it’s readable, and it pertains to your account, then they have complied fully.

    No signature is required, I see nothing untoward here.

    What is your strategy for dealing with it? Are you hoping to ignore so that it times out after 6 years and how long do you have to go?

    Have you taken advice from a debt charity e.g. Stepchange in case there are other debts to be considered and paying Cabot would just cause issues with other creditors - plus your family.

  • Thank you, I understand no signature required, I do note that it's not dated and no mention of a credit limit?

    In regard to strategy, this forms part of a wider DMP that I am self managing.

    The statement of account provided did not show any virgin statements only some initial payments to Cabot - does this matter?

    I'm in the process of trying to get a SAR from Virgin to check statements, interest and any charges made to the account. Having a bit of trouble getting them to provide me the information so going to send a written request.

    Is it worth informing them/starting a token payment with Cabot whilst I do this?
